[ CUSTOMS MEMORANDUM ORDER NO. 7-90, October 10, 1990 ]

TAKING OF SAMPLES FROM SHIPMENTS



In view of the reported widespread abuses in the taking of samples from shipments under examination, it is hereby ordered that samples shall be taken only for purposes of laboratory examination or when the same is absolutely necessary as an aid in the determination of the value of the shipment, provided that — 

1.         Samples shall be limited to one of its kind; 

2.         Samples taken shall be signed for and acknowledged by the requesting party; 

3.         Immediately after examination of the samples, the same shall be returned to the importer/consignee by the requesting/receiving party.

The examining official, the CIIS and ESS representatives, and other responsible persons witnessing the conduct of an examination are hereby enjoined to observe and enforce this Order.

Any violation of this Order shall be dealt with severely.

This Order shall take effect on February 2, 1990 and shall last until revoked.
