[ CSC MEMORANDUM CIRCULAR NO. 32, s. 1997, December 18, 1997 ]

REITERATION OF MEMORANDUM CIRCULAR NO. 32, SERIES OF 1993




The Civil Service Commission has issued a policy on Entrepreneurial Activities of Government Employees in a Memorandum Circular No. 32, s. 1993 which states that:
"Cognizant of the reasons behind economic ventures, entrepreneurship may be allowed subject, however, to the following conditions:

1. That government employees shall strictly observe Section 7, paragraphs (a), (b), and (c), of R.A. 6713 which declares as unlawful the following acts and transactions of any public official and employee;

2. That the conduct of business or economic ventures shall not conflict or tend to conflict with the official functions of the public official or employee;

3. That the conduct of business or economic ventures shall not be done during office hours nor within the required forty (40) hour work week period;

It has been noted that even after the issuance of the said Memorandum Circular, several officials and employees engage in entrepreneurial activities during office hours which disrupt the delivery of services to the public. In view thereof, the Commission reiterates the prohibition of said entrepreneurial activities pursuant to Section 2 of R.A. 6713.

WHEREAS, Section 2 of RA 6713 states that it is the policy of the state to promote a high standard of ethics in public service. Public officials and employees shall at all times be accountable to the people and shall discharge their duties with utmost responsibility, integrity, competence, and loyalty, act with patriotism and justice, lead modest lives, and uphold public interest over personal interest.

WHEREAS, the Civil Service Commission has issued a policy on Entrepreneurial Activities of Government employees as contained in Memorandum Circular No. 32, s. 1993;

WHEREAS, cognizant of the reasons behind economic ventures, Entrepreneurship may be allowed subject however to the conditions that government employees shall strictly observe Section 7, paragraphs (a), (b), and (c) of R.A. 6713;

WHEREAS, it is imperative that the conduct of business or economic ventures shall not conflict or tend to conflict with the official functions of the public official or employee and shall not be done during office hours nor within the required forty (40) hour work week period;

WHEREAS, it has been noted that after the issuance of the said Memorandum Circular, several officials and employees still engage in entrepreneurial activities during hours which disrupt the delivery of services to the public;

WHEREFORE, foregoing premises considered, the Commission resolved as it hereby resolves to reiterate the prohibition of entrepreneurial activities pursuant to Section 2 of R.A. 6713.
