[ SRA SUGAR ORDER NO. 9, s. 1993-94, December 15, 1993 ]

REINSTITUTION OF VERIFICATION/SIGNING OF SUGAR RELEASE ORDER



WHEREAS, SRA Sugar Order No. 5, Series of 1992-1993, dated September 17, 1992, was promulgated for the purpose of standardizing procedures in the release/withdrawal of sugar from mill warehouses and prescribing thereunder the issuance by all mill companies of a uniform Sugar Release Order (SRO) for the proper release/withdrawal of sugar from their warehouse;

WHEREAS, Section 2 of the aforesaid SRA Sugar Order no. 5 provides that the SRO prepared, approved and signed by the authorized representative of the mill company shall be verified correct and signed by the authorized representative of the planters association/cooperative concerned prior to release/withdrawal of sugar from mill warehouses;

WHEREAS, SRA Sugar Order no. 5-A, Series of 1992-1993, dated November 5, 1992, by way of amendment to Section 2 of Sugar Order No. 5, provides that a copy of the SRO prepared, approved and signed by the mill representative shall merely be furnished to the planters association/cooperative concerned and should there be any objection as to the correctness thereof, the objection shall be made within 24 hours from presentation and in writing;

WHEREAS, some planters associations have requested that the provisions of Section 2, of SRA Sugar order No. 5, with regard to verification and signing of the SRO by the representative of the planters association/cooperative concerned prior to release/withdrawal of sugar from mill warehouses be reinstituted;

NOW, THEREFORE, under and by virtue of the powers vested in the Sugar Regulatory Administration, it is hereby ordered that:

SECTION 1.       (a) Any planters association/cooperative may petition the SRA Administrator if they desire a reinstitution of the provisions of Section 2 of SRA Sugar Order No. 5, Series of 1992-1993, with regard to the signing of the prepared and approved SRO by the representative of the planters association/cooperative concerned prior to release/withdrawal of sugar from the mill warehouse;

(b)       In such case, the Administrator may grant said petition, subject to such terms and conditions as he may deem appropriate.

SECTION 2.       This Sugar Order shall take effect immediately.

SECTION 3.       Provisions of sugar orders, circular letters, rules and regulations contrary to or inconsistent herewith are hereby revoked, amended or modified accordingly.
