WHEREAS, a Memorandum Order dated September 2003 was issued by the President of the Philippines approving the Implementing Rules and Regulations of Republic Act 9184 (RA 9184), otherwise known as Government Procurement Reform Act;

WHEREAS, under the said IRR, specifically Section 15 of RA 9184 mandates the "payment of honoraria to the BAC members x x x subject to availability of funds." It further provides that "the Department of Budget and Management (DBM) shall promulgate the necessary guidelines";

WHEREAS, pursuant to the said Provision, the DBM issued Budget Circular No. 2004-5 dated 23 March 2004, providing the guidelines on the grant of honoraria to government personnel involved in government procurement;

WHEREAS, Section 5 of the said Circular provides that the agencies may retain fifty percent of their collections from fees and charges related to procurement for payment of honoraria of BAC and TWG members;

WHEREAS, in order to generate funds for the payment of said honoraria, the Bureau of Agricultural Statistics (BAS) should start collecting fees from the participating bidders for the sale of bid documents, minutes of bidding and other related fees, starting January of this year;

WHEREAS, the BAS-BAC, after conducting research on the subject, recommends the following fees to be charged to the participating bidders who will secure bid forms;

NOW, THEREFORE, the BAS-BAC hereby resolves as it hereby resolved to recommend, for approval by the Director, the collection of fees and charges related to bidding at the rates above stated;

RESOLVED, FURTHER, that the BAS be authorized to immediately start collecting fees from the bidders upon approval of this Resolution.
