[ BOC-PEZA JOINT MEMORANDUM ORDER NO. 1-2001, FEBRUARY 15, 2002, February 15, 2002 ]

SUPPLEMENT TO JOINT MEMORANDUM ORDER NO. 01-2001




Pursuant to the Memorandum of Agreement entered into between BOC and PEZA dated 28 April 2001, the following rules and regulations, are hereby issued to supplement Joint Memorandum Order No. 01-2001 (JMO 01-2001) for the purpose of providing an interim mechanism for the Direct Trader input lodgment of cargo transfer applications at the NAIA Customs Collection District:

1.0 Objectives

1.1 Improve the efficiency of the Customs-PEZA Cargo Transfer System at NAIA which was implemented on 14 January 2002;

1.2 Relieve the congestion in the filing of transfer declarations at the Customs-PEZA Clearance Office (CPCO) and speed up the lodgment process;

1.3 Actualize the objectives of Customs Memorandum Order No. 4-97 (CMO 4-97) which is the primary CMO on Remote Lodgments using ACOS Direct Trader Input Facility; and

1.4 Actualize the reform measures of JMO 01-2001 by enabling economic zone locator enterprises to undertake remote lodgments of their import cargo transfer applications

2.0 Scope

2.1 This Order shall be applicable to the NAIA Implementation of the Transfer System for import cargoes arriving at NAIA and bound for PEZA-registered economic zones.

2.2 The principles enunciated in this JMO on the processing DTI-lodged transfer application shall to the extent possible, also be adopted in all other ports to which JMO 01-2001 shall be rolled-out subsequently.

3.0 General Provisions

3.1 General Provisions 3.1, 3.3, and 3.4 of CMO 4-97 shall be, observed to the extent consistent with the provisions of this Order.

3.2 Responsibility for ensuring adequacy of the communication facility under General Provision 3.2 of CMO 4-97 shall now be exclusively vested on the Deputy Commissioner for MISTG.

3.3 The MOA under General Provision 3.3 of CMO 4-97 shall likewise be signed by the Deputy Commissioner, MISTG for import cargoes arriving at NAIA and bound for PEZA-registered economic zones.

3.4 Brokers and importers who are already accredited to lodge via DTI either for warehousing or consumption entries need not be accredited further under this Order to avail of DTI for the Customs-PEZA Cargo Transfer System.

4.0 Operational Provisions

4.1 Activities of Importers and for Authorized Brokers

4.1.1 Activities of Importers and /or Authorized Broker's

Importers and/or their authorized representatives/brokers shall encode all pertinent information using Client side ACOS software (Module MODBRK). DTI entries shall use "8DT" as its Model of Declaration code to distinguish it from other entries.

Importers and/or their authorized representatives/brokers shall then connect to the port servers and invoke the "Check" option in order to check the integrity of encoded data.

4.1.2 Registration of Entry to BOC

Importers and/or their authorized representatives/brokers shall register entry with BOC and request for assessment of entry.

4.1.3 Printing of Transit Authorization Note (TAN) and Single Administrative Document

Importers and/or their authorized representatives/brokers shall print a copy of the SAD and two copies of the TAN for submission to Customs with the other required import documents.

4.1.4 Payment of Cargo Transfer Fee

An auto-debit system (MODACC for the Cargo Transfer Fee) shall be implemented to automate the collection of cargo transfer fees and charges. Pending implementation of such system, the importers and/or their authorized representatives/brokers shall present the SAD to the Collection Division for payment. This step shall be removed once an auto-debit system is in place.

4.1.5 Obtaining Transit Authorization at CPCO

The Transit SAD and TAN, together with the other supporting documents, shall be presented by the importers and/or their authorized representatives/brokers to the CPCO for final processing and issuance of the delivery copy of the transit document.

4.2 Collection Division (CD)

An auto-debit system shall be implemented to automate the collection of P1,015 cargo transfer fee (or the amount to be later on prescribed).

Pending activation of the auto-debit system, the CD shall collect the P1,015 cargo transfer fee (or the amount to be later on prescribed), issue Bureau of Customs Official Receipt (BCOR) for the purpose, stamp "PAID" on the face of the SAD, attach one copy of the TAN to the BOC copy of the BCOR and return the SAD with supporting documents to the importer or his representative, who will lodge the same at the CPCO.

4.3 CPCO-PEZA Section

An Electronic import Permit Systems shall be implemented to automate the verification and validation of import, permits. Pending implementation of such a System, the CPCO-PEZA Section shall receive the Transit-SAD from the importers and/or their authorized representatives/brokers and verify/validate the Import Permit issued from the Zone, and other supporting documents attached to the SAD. Upon completion of this process, the CPCO-PEZA section shall forward the documents to the CPCO-Customs Section, bypassing the PCCI Section.

4.4 CPCO-Customs Section

An Automated Verification System shall be implemented to automate all the verifications required (availability of surety bond, presence of Hold Alert Orders and Manifest Clearances).

Pending the automation of the various verifications required, the CPCO Customs Section shall perform all the steps from 6.4.1 to 6.4.6 except 6.4.5 of JMO 01-2001 to include the authentication of the DTI printed SAD and the TAN using an ACOS terminal to be made available for the purpose.

Release of transit authorization shall continue as in 6.5 of JMO 01-2001 as implemented under NAIA CMO No. 3-2001. In as much as there is no OLRS machine for Warehousing and Transit at NAIA, the lifting of duty stop is dispensed with.

5.0 Applicability of Non-Conflicting Provisions of JMO 01-2001 and NAIA CMO 3-2001

All provisions of JMO 01-2001 and NAIA CMO provisions of this JMO shall remain in effect.

6.0 Repealing Clause

All rules and regulations inconsistent with this Order are hereby deemed repealed, suspended or modified accordingly.

7.0 Effectivity

This Order shall take effect upon approval.
