HAZARD DUTY PAY



1. Section 44 of the General Provisions of RA 8250 or the FY 1997 General Appropriations Act which authorizes the grant of hazard duty to government personnel assigned in certain posts or work areas has been vetoed by the President. Government entities have no authority therefore to grant in 1997 hazard duty pay to their personnel except those agencies specifically authorized to pay such benefit under special laws like RA 4670 or "The Magna Carta for Public School Teachers" and RA 7305 or the "Magna Carta of Public Health Workers."

2. Although the grant of hazard duty pay to Public Health Workers pursuant to RA 7305 is not included in the said veto, the grant of new or increased benefits, which include hazard duty pay, is however suspended pursuant to Section 7 of Administrative Order (AO) No. 170 dated December 13, 1994 of the Office of the President unless there is prior consultation with local government units as to their financial capability to extend the same benefits to the locally-paid health workers.

3. Until the said consultation is completed/worked-out and a joint circular of the Department of Health, Department of Budget and Management and Department of Interior and Local Government is issued relative to the payment of hazard duty pay to Public Health Workers pursuant to RA 7305, the said suspension still holds.
