[ POEA MEMORANDUM CIRCULAR NO. 2 S. 1983, December 29, 1983 ]

GUIDELINES AFFECTING THE AREA MANNING UNITS OF THE THEN NATIONAL SEAMEN BOARD



Considering that Executive Order No. 797 dated 01 May 1982 abolished the area manning units as implementing arms of the then National Seamen Board in the regional levels and its possible operationalization in the near future has yet to be decided by the Philippine Overseas Employment Administration, the following guidelines are hereby issued :

A.

Its De- activation


Effective 15 February 1983, the various area manning units shall cease to operate.  This shall be widely disseminated to its clientele e.g. seaman applicants, seamen‘s beneficiaries, maritime schools, accredited training centers and those shipping companies based in its respective regions.  All its former duties and responsibilities shall henceforth be concentrated and performed by the Administration.

B.

Its Personnel


All AMU personnel whose names were included in the designations made per Ministry Order No. 1 are hereby ordered to report to the Administration effective the date their offices ceased operation.   They shall be entitled to reimbursement of actual transportation expenses incurred.

In view thereof, all parties to the employment of any Filipino seaman on board any ocean-going vessel are advised to adopt and use this employment contract effective 01 February 1984 and to desist from using any other format of employment contract effective that date.

It is, however, informed that the new schedule of benefits provided in this contracts shall apply to any Filipino seaman already on-board any ocean-going vessel by virtue of the old standard format of service agreement duly approved by POEA provided that the cause of action occurs February 1, 1984 on thereafter .

The terms and conditions provided in this revised employment contract are the minimum requirements acceptable to the Ministry of Labor and Employment/Philippine Overseas Employment Administration for the employment of a Filipino seaman.  They may, therefore, be improved upon by the parties concerned if the parties so desire.  Such amendments or improvements to this contract however, must be put in writing annexed to the contract and submitted to the appropriate offices of the POEA when processing contracts of employment for seaman.

The adjudication Department of this administration shall therefore use only this contracts and any approved addendum therein including pertinent laws and regulations in adjudicating any and all claims of any party to an employment of a seaman.
