[ POEA MEMORANDUM CIRCULAR NO. 6 S. 1983, February 18, 1992 ]

CLARIFYING M.O. 2, S. 1983 ON CHARGING OF FEES



In response to numerous inquiries received from various sectors, the following clarifications are being issued relative to POEA Memorandum Order No. 2 of 1983:

1. The total fee which a recruitment agency may charge its outgoing workers is P2,500.  This includes all costs relative to his recruitment, documentation and employment except the performance bond.

2. Workers are not required to pay ten thousand pesos in cash as performance bond.  They are supposed to pay only the premium (not more than P300) necessary to cover the cost of a performance bond which shall be equivalent to the cost of a round trip plane fare from Manila to the country of destination but not to exceed P10,000.00.

3. Where there is no need for immediate repatriation of any worker, the agency must advance the repatriation costs collectible from the bonding or surety company.

4. Manning agencies shall not charge any documentation fee except the premium for the performance bond.

5. Authority holders (construction or service contractors) may charge a miximum documentation fee of P700 and the cost of premium for the performed bond.

6. Violations of Memorandum Order No. 2 are subject to the Memorandum Order No. 2-A on Administrative Sanctions approved by the POEA governing board on October 29, 1982.
