[ POEA MEMORANDUM CIRCULAR NO. 20 S. 1983, June 17, 1983 ]

RULES AND REGULATIONS ON THE ACCREDITATION OF MEDICAL CLINICS AND THE CONDUCT OF MEDICAL EXAMINATION FOR OVERSEAS WORKERS[*]



Please be informed that the Minister of Labor and Employment and the Minister of Health have very recently signed and approved the Joint Ministry of Health (MOH)-Ministry of Labor and Employment (MOLE) Rules and Regulations for the Accreditation of Medical Clinics and the Conduct of Medical Examination for Overseas Workers effective 01 June 1983.  Among others, the Rules provide that:

1) The conduct of medical examination for overseas workers shall be done only by duly accredited medical clinics or hospitals;

2) The fee for the basic pre-employment medical examination shall not be more than P120.00;

3) The fee may be shouldered by the worker-applicant (except when the same is paid for by the employer as part of his mobilization expenses and shall be paid directly to the clinic which shall issue a corresponding receipt to the worker.  If the fee is paid for by the worker-applicant, the amount shall be deducted from his placement fee of P2,500;

4) Referral for medical examination shall be made by the Agency only after the worker shall have been interviewed or trade tested and the agency/employer shall have decided to accept the worker for an overseas job.  The conduct of pre-employment medical examination on an applicant who has no overseas job acceptance is a violation of the rules;

5) To protect the Agencies, medical clinics shall guarantee the integrity of their medical examination results within a period of three (3) months and for this purpose, shall post a cash bond with the POEA to answer for repatriation of workers arising from faulty medical examinations;

6) In the meantime that the two Ministries are working on the applications for accreditation of various clinics, Agencies may continue referring their recruits to their present medical retainers. This shall, however, be true only until August 31, 1983.  Effective 01 September 1983, only medical clinics or hospitals duly accredited by the two Ministries shall conduct medical examinations for overseas workers; and

7) Violation of any provision of the Rules shall be subject to the suspension or cancellation of the Agencies' authority or license or recruit workers for overseas employment.

Copies of the Rules may be obtained from the Office of the Director, Workers' Assistance and Adjudication Office, this Administration.
