[ POEA MEMORANDUM CIRCULAR NO. 05 S. 1986, February 10, 1986 ]

ADJUSTMENT IN RATES OF COMPENSATION AND BURIAL BENEFITS AND CLARIFICATION RELATIVE TO POST-EMPLOYMENT MEDICAL EXAMINATION



Pursuant to the recommendation of the Tripartite Technical Working Group on the Revision of the Standard Employment Contract for Seamen, you are hereby advised that effective March 1, 1986, the amounts of compensation and burial benefits as specified under Part II, Section C, paragraph 1 & 3(c) shall read as follows:

"Section C. Compensation and Benefits -

1. In case of death of the seaman during the term of his Contract, the employer shall pay his beneficiaries the amount of:

a. P250,000.00 - for Master & Chief Engineers

b P210,000.00 - for other officers including Radio Operators and Master Electricians

c. P170.00 - for ratings

3.c.  If the remains of the seaman is buried in the Philippines, the owners shall pay the beneficiaries of the seaman an amount not exceeding P20,000.00 for burial expenses."
The foregoing upgraded benefits shall be applicable to all Filipino seamen on board any ocean-going vessel provided the cause of action occurs on March 1, 1986 and thereafter.

In connection with paragraph 4, subparagraph c of the same Section C, please by reminded that the required post-employment medical examination of the seaman within seventy-two (72) hours upon his return shall apply only to seamen being repatriated or disembarked for medical reasons. Seamen repatriated or disembarked for other reasons shall not be required to undergo post-employment medical examination.
