[ HLURB MEMORANDUM CIRCULAR NO. 40, S. 1999, February 28, 2000 ]

RESOLUTION NO. 650, AMENDING ARTICLE 5, SECTIONS 13, 14, 18 AND 19 OF THE MODEL ZONING ORDINANCE (MZO) TO INCLUDE SLAUGHTERHOUSE/ABATTOIR AS AN ALLOWABLE USE



Quoted hereunder is the full text of the subject resolution passed by the Board of Commissioners in its 276th Regular Meeting on 11 August 1999:

“WHEREAS, the Housing and Land Use Regulatory Board (HLURB) by virtue of Executive Order No. 648, as amended by Executive Order No. 90, is mandated to promulgate zoning and other land use control standards and guidelines which shall govern the land use plans and zoning ordinances of local governments;

WHEREAS, the Revised Model Zoning Ordinance (MZO) was approved per Board Resolution No. 590, Series of 1996 included slaughterhouses/abattoirs only in Heavy Industrial Zones (1-3) wherein the activities are classified as Highly Pollutive/Non-Hazardous Industry,

WHEREAS, upon the recommendation of the National Agricultural and Fishery Council (NAFC), a Committee on Poultry, Livestock and Feed Crops (CPLFC) was created and composed of representatives from the private sector, the academe and the government to inspect slaughtering facilities and submit recommendations which would promote a healthy environment within the facilities’ respective areas of operation;

WHEREAS, “A Report of the Task Force on the Consolidation of Sanitation Laws on Slaughterhouses and Related Facilities” was completed in June 1998 under the umbrella of the Department of Agriculture (DA) with recommendations on issues raised relevant to slaughterhouses/abattoirs;

WHEREAS, the report/recommendation of the Task Force has to be harmonized with the Revised Model Zoning Ordinance and the Sanitation Code for uniformity and consistency;

WHEREFORE, be it RESOLVED, as it is hereby RESOLVED, that Sections 13, 14, 18 and 19 of the Model Zoning Ordinance and the following conditions shall be observed as illustrated in Figure 1.

a)      The Site and Location of slaughterhouse/abattoir shall be at least 200 meters from residential areas, schools, churches and other places of assembly courts or public office. It should be accessible to transportation.

b)      Abattoirs/slaughterhouse should be at least 25 meters from markets and other food establishments.

Section 13.   Use Regulations in Medium Industrial Zone (I-2). — An I-2 Zone shall be for pollutive/non-hazardous and pollutive/hazardous manufacturing and processing establishments. Enumerated below are the allowable uses:

a.       Pollutive/Non-Hazardous

58.    SLAUGHTERHOUSE/ABATTOIR (CLASS A & AA)

Section 14.         Use Regulations in Heavy Industrial Zone (I-3), An I-3 Zone shall be for highly-pollutive/non-hazardous; highly pollutive/hazardous; highly pollutive/extremely hazardous; non-pollutive/extremely hazardous; and pollutive/extremely hazardous manufacturing and processing establishments. Enumerated below are the allowable use:

a.       Highly Pollutive/Non-Hazardous

21.       OTHER PROCESSING, PRESERVING AND CANNING OF MEAT PRODUCTS N.E.C.

22..      SLAUGHTERHOUSES/ABATTOIRS (ALL CLASSES AAA, AA & A)

Section    18. Use Regulations for Agricultural (Agr.) Zone (AGZ). In Agr. Zones, the following uses shall be permitted:
