RESPONSIBILITY FOR VIOLATION OF P.D. 1986 AND IMPLEMENTING RULES AND REGULATIONS AND IMPOSITION OF CORRESPONDING PENALTIES



We have observed of late violations of Presidential Decree No. 1986 and its Implementing Rules and Regulations by TV producers/blocktimers, particularly with regard to the exhibition of programs without the corresponding Permit to Exhibit.

Section 7 of P.D. 1986 provides that it shall be unlawful to exhibit any motion picture, television program or publicity material not passed by the Board, except those imprinted or exhibited by the Philippine Government and/or its departments and agencies, and news reels.

Memorandum Circular No. 98-17 issued by this Board provides that exhibiting without a valid permit to exhibit shall merit the following penalties:

 

For TV Station/Production Outfit

For Owner of Print/Program Producer

 

 

 

First Offense

One (1) month closure

Six (6) months suspension of PTE/prohibition from applying for PTE and confiscation of film print or material

 

 

 

Second Offense

Six (6) months closure

One (1) year suspension of PTE/prohibition from applying for PTE and confiscation of film print or material

 

 

 

Third Offense

Revocation of Certificate of Registration and One (1) year closure

Permanent Prohibition from applying for PTE and confiscation of film print or material

In this regard, all concerned are reminded of the need to secure a Valid Permit to Exhibit prior to the exhibition of any television material. All TV stations/managers are enjoined to demand that the PTE's are presented/submitted to them prior to airing. Failure to comply with this requirement will result in the imposition of the appropriate sanctions on both the program producers, whether the material be produced by the station or by independent producers, and the TV station airing the same.
