AMENDMENT TO MEMORANDUM CIRCULAR NO. 16, SERIES OF 1988, ADVERTISEMENT FOR OVERSEAS JOB VACANCIES



In line with the deregulation thrust and full disclosure policy of this Administration, Memorandum Circular No. 16, Series of 1988, prescribing the guidelines on advertisement for overseas job vacancies, is hereby amended to provide for the following:

1. Advertisement for Accredited Principal/Project

Licensed Agencies may advertise without prior approval by this Administration job vacancies by their foreign accredited principal covered by job orders duly approved by the Administration, provided that the name of their foreign principal is disclosed. A letter-advice to the POEA by the agency, together with the text of the advertisement, shall suffice.

2. Advertisement for Manpower Pooling by Agencies for Accredited Principal/Project

Agencies desiring to generate qualified applicants for additional manpower requirements of an accredited principal or project not covered by duly approved job order by the Administration may advertise only upon approval by the Administration.

3. Advertisement for Manpower Pooling by Agencies for Prospective Principal/Project

Agencies desiring to generate qualified applicants for a prospective principal/project may advertise only for professional, highly skilled and technical positions and marine officers and only upon prior approval by the Administration.

4. Advertisement for Data Banking for Agencies

Agencies desiring to expand their data bank may advertise only for professional, highly skilled and technical positions and only upon prior approval by the Administration.

5. Sanctions

False and deceptive advertisements published and aired by agencies/entities including but not limited to those published not in accordance with the prescribed guidelines shall be considered as violation and shall, therefore, be a valid ground for the suspension and/or cancellation of license without prejudice to possible criminal liabilities under existing laws.

All other issuances inconsistent herewith are modified accordingly.

This Memorandum Circular shall take effect after fifteen (15) days from publication in a newspaper of general circulation.
