CARGO HANDLING RATES FOR BAGGED AND FROZEN CARGOES AND STANDBY TIME CHARGES



1 .         Authority

1.1       Section 20 of P.D. 857
1.2       PPA Board Resolution No. 99-665

2.         Scope - This order shall cover cargo handling rates for (a) all bagged and frozen non-palletized/non-containerized fish cargoes discharged from/loaded onto vessels berthed/moored at the South Harbor or Manila International Container Terminal; and (b) standby charges on conventional cargoes.

3.         Objective - In order to minimize delays attributable to the fault of importers or consignees and rationalize the handling rates for bagged and frozen cargoes and charges for standby time.

4.         Definition of Terms

4.1    Bagged Cargoes — refer to homogenous cargoes packed in sacks or bags, not palletized nor containerized which are loaded onto or discharged from a vessel manually (ex. soda ash in sacks and cement in bags).
4.2    Frozen Cargoes — refer to frozen fish unpacked or in cartons/packages not palletized nor containerized, loaded onto or discharged from a refrigerated vessel manually (ex. frozen fish unpacked in cartons).
4.3    Standby Time — refers to the unproductive hours incurred by a deployed gang on account of factors not through the fault of the cargo handler as enumerated in 6.3 hereof.
4.4    Productivity — refers to total tonnage handled net of total standby time.

5.         New Rates - Cargo handling rates for bagged and frozen cargoes and standby charges are, as follows:

6.         Terms and Conditions

6.1    In line with tariff corrections on bagged and frozen cargoes, the cargo handling operators at the above ports shall achieve minimum net productivity of at least 200 metric tons/gang/shift for bagged cargoes and 85 metric tons per gang per shift for frozen cargoes.
6.2    In the event that the herein net productivity for bagged and frozen cargoes falls below the prescribed minimum, the rates prior to this increase as shown below, shall apply:

6.3    Standby time charges shall be applied on delays beyond the control of the cargo handling operator, only under the following circumstances.

a.         waiting for vessel to dock;

d.         non-readiness of the vessel;

b.         breakdown of vessel's gear,

e.         gang cancelled by client due to instances other than the above.

6.4    Standby time charges due to inclement weather shall not apply except when the cargo owner/consignee insists on the deployment of a gang or objects to the knocking off of the gang during or impending inclement weather.
6.5    All queries, problems and interpretations arising out of the provisions of this Order, shall be referred to the Office of the AGM-Operations, ATTN: Commercial Services Department (CSD) for final resolution.

7.         All PPA orders inconsistent herewith, are hereby repealed or amended accordingly.

8.         This Order shall take effect fifteen (15) days after its publication in any newspaper of general circulation.
