REVISED RULES AND REGULATIONS ON LIMITED ACCESS FACILITIES

I</B>
</CENTER>

The Toll Regulatory Board (or the Board), in accordance with Department Order No. 74, hereby declares the North and South Luzon Expressways, including the Balintawak to Tabang Section of the North Luzon Expressway and the Nichols to Alabang Section of the South Luzon Expressway, as Limited Access Facilities or Expressways.

As Limited Access Facilities the said expressways shall be covered by the following rules and regulations:

<I>SECTION 1.</I> No person or vehicle shall have any right of ingress or egress to, from or across the Limited Access Facilities, and to or from abutting lands except at such designated entry/exit points/interchanges at which access may be permitted by the Board. As such, it shall be unlawful for anybody to remove or cause the removal and/or, open or cause the opening of the limited access fences or right-of-way fences along the sides of the Limited Access Facilities.

<I>SECTION 2.</I> No person or group of persons shall be allowed or permitted to stand, stop, load, unload, or park a vehicle in the Limited Access Facilities, except in places provided therefor. In cases of vehicle emergency, breakdown or accident, impaired vehicle/s shall be removed from the travelway by authorized towing operators without delay at the expense of the owner and/or the driver thereof;

<I>SECTION 3.</I> The following vehicles shall not be allowed in the Expressway at any time:

a.  motorcycles, tricycles and bicycles;

b.  vehicles being towed, except those which are being removed from the Expressway;

c.  vehicles which are dilapidated and not road-worthy (i.e. vehicles without headlights, tailights, brakelights; vehicles with misaligned chassis, bald tires; etc.)

d.  smoke-belchers;

e.  trucks carrying construction aggregates (including sand, gravel and fill materials) not leveled and/or without cover;

f.   vehicles with cargo not battered down and/or not firmly fastened; and

g.  Trucks exceeding the following Gross Vehicular Weight of Truck and Load

Two Axle Trucks   — 20 Metric Tons
Three Axle Trucks — 36 Metric Tons
Four Axle Trucks  — 52 Metric Tons
Five Axle Trucks  — 68 Metric Tons

<I>SECTION 4.</I> Trucks with 6-wheels and more whether carrying cargo or not shall not be allowed inside the Limited Access Facilities during the following hours from Mondays to Fridays only, except holidays:

a. For the North Luzon Expressway:

6-9 AM Southbound (Tabang-Balintawak)
4-8 PM Northbound( Balintawak-Tabang)

b. For the South Luzon Expressway:

6-9 AM Northbound (Alabang-Nichols)
4-8 PM Southbound (Nichols-Alabang)

<I>SECTION 5.</I> Any vehicle which stalls or is demobillized within the Limited Access Facilities for any reason shall be towed by an authorized towing operator under the following rules:

a.  stalled vehicles shall be towed out of the nearest exit and brought to the nearest impounding area or authorized garage by MMA accredited towing vehicles.  In case of flat tires, vehicles shall not be towed outright  and given sufficient time for tire changing;

b.  cost of towing shall conform to the MMA Schedule of Towing Fees;

c.  towing fees shall be paid by the tower and/or driver of the stalled/demobilized vehicle before or after towing. Otherwise, owner/driver shall sign a promissory note and impaired vehicle shall be released after payment of full amount; and

d.  any damage or loss to vehicle while in the process of towing shall be the sole responsibility of the owner/driver of the stalled/demobilized vehicle.

<I>SECTION 6.</I> Lane No. 1 or the lane nearest the divider or center island shall be used only by vehicles which are travelling at faster but within allowed speed limits and/or are overtaking. However, overtaking vehicles do not have the right-of-way. Cargo trucks, buses, and slow-moving vehicles are NOT allowed in Lane No. 1 at all times;

<I>SECTION 7.</I> Damage to expressway property such as among others, lamp post, perimeter fence, traffic island divider, building, etc. shall be paid for the damage, based on the assessment of the responding/apprehending  officer, to the Toll Regulatory Board (TRB) or to the Philippine National Construction Corporation (PNCC) as the case may be.

<I>SECTION 8.</I> Speed Limit of Vehicles shall be as follows:

a. Trucks         — 60 km per hr. Minimum/Maximum
b  Other Vehicles — Nichols to Alabang and Balintawak to Tabang

60 km. per hr. Minimum
80 km. per hr. Maximum

—Alabang to Calamba and
Burol-Dau

60 km. per hr. Minimum
100 km. per hr. Maximum

<I>SECTION 9.</I> Any kind of advertisements in the form of billboards, streamers, posters or the like shall be prohibited inside the Limited Access Facilities except at such places designated, and in accordance with such specifications approved, by the Board.

Repealing Clause</B>
</CENTER>

All previous orders and instructions inconsistent herewith are hereby modified or repealed accordingly.

</CENTER>

These revised rules and regulations shall take effect fifteen (15) days after publication in a newspaper of general circulation.
