AMENDMENT TO A.O. SERIES OF 1993

PART II — GENERAL PROVISIONS

Sec. 4.          Guarantee of Prompt Payment and Compliance of the provisions of the contract.  To guarantee prompt payment of fees and charges covered by contract leases and/or concessions as well as compliance of the provisions of the contract, excluding government agencies whose functions are essential in the operations of the airport and airlines, a deposit either in the form of Manager Check or cash shall be made with the Authority, the amount of which shall be equivalent to three (3) months rentals and Concession Privilege Fee, one (1) month advance, and a Surety Bond from GSIS in the amount equivalent to the total rentals and CPF during the term of the contract but not to exceed P5 Million or a cash bond in the amount not exceeding P2 Million.  These shall be maintained during the duration of the lease/ concession, and in the case of default, shall be automatically applied to the back accounts. In the event a Surety Bond cannot be posted upon contract signing, the lessee/concessionaire shall be required to post surety cash deposit in the amount corresponding to four (4) months rentals and concessions privilege fees, refundable upon posting of the surety bond.  Failure to post the required Surety Bond within a period of two (2) months shall automatically cancel the effectivity of the contract. Deposits, advances and bonds which were applied to back accounts, should be restored within five (5) days from the date they were applied, otherwise the contract shall be rendered ineffective after the lapse of the said period.

That, the foregoing Resolution is still in full force and effect, and has not been repealed, amended, or modified as of this date.
