Subject: Inclusion of New Tariff Lines and Chicken and Chicken Products in the Imposition of SSG Duty as Per Customs Memorandum Order No. 28-2004

Dear Commissioner Jereos:

This is in view of the reinstatement of the imposition of the price-based Special Safeguards (SSG) Duty on the importation of chicken and chicken products, pursuant to Customs Memorandum Order No. 28-2004, dated 08 October 2004.

We understand that in the latest Tariff and Customs Code of the Philippines (The ASEAN Harmonized Tariff Nomenclature) "other cuts and offal of the species Gallus domesticus, frozen, with HS Code 0207.14 92 has been modified and items which were formerly under the aforementioned heading had been assigned their own tariff codes. In our consultation with the Tariff Commission and the DA Policy group, with reference to the 2001 TCCP in which the list of SSG-Eligible agricultural products were based from, the following items previously belonged to Tariff heading 0207.14 92, and therefore, are still subject to the imposition of SSG duty:

In light of this, we are requesting the inclusion of the above items in the imposition of SSG duty, as per CMO 28-2004.
