[ LTFRB MEMORANDUM CIRCULAR NO. 2004-023, August 17, 2004 ]

AMENDMENT TO MEMORANDUM CIRCULAR NO. 91-004 (RE: REGISTRATION OF UNITS)



The Board issued Memorandum Circular No. 91-004 (Re: Registration of Units), dated 25 January 1991, declaring therein that operators are required to register the authorized units within thirty (30) days from receipt of the Decision as one of the conditions in the Certificate of Public Convenience.

After a circumspect review of said MC No. 91-004, the Board hereby amends the third paragraph of the said Circular to read as follows:

"In the interest of public service, the Board hereby sets a policy that failure to register any of the authorized units with LTO within thirty (30) days from receipt of the Decision as required therein shall forever bar the registration of the unregistered units, hence, can no longer be operated as For-Hire vehicles.  Any Petition/Motion for Late Registration shall no longer be approved, except in a very exceptional case as may be determined and approved by the Board en banc."

All other issuances or parts hereof which are inconsistent herewith, are therefore modified or superseded accordingly.

This Circular shall take effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
