[ LTFRB MEMORANDUM CIRCULAR NO. 2004-026, September 06, 2004 ]

AMENDMENT TO MEMORANDUM CIRCULAR 2004-011, RE: AMENDMENT TO MEMORANDUM CIRCULAR 2003-001 (RECLASSIFYING TOURIST TRANSPORT SERVICE)



Relative to the Letter of Atty. Oscar P. Palabyab, Undersecretary of the Department of Tourism Service and Regional Offices to Land Transportation Franchising and Regulatory Board (LTFRB) Chairperson Maria Elena Bautista, dated August 03, 2004, Re: Extension of Age Requirement to Ten (10) Years for Cars and Vans with Tourist Coupon Service Franchise, the Board hereby amends the age requirement for all units for the Tourist Transport Service, which shall be ten (10) years irrespective of the type of units.  Thus, the paragraph amending the age requirement should now read as:

"The age requirement for all types of units for the above transport service is ten (10) years from the date of manufacture.  A brand new unit, for this purpose means a unit manufactured in the current year when the application is filed."

This Board likewise clarifies that the endorsement from DOT, as a requirement in the acceptance for Petition for Conversion, is no longer required as long as the valid DOT accreditation issued annually is presented.

This Memorandum Circular supersedes any and all issuances inconsistent herewith.

This Order shall take effect immediately.

So ordered.
