RESOLUTION NO. R-694, APPROVING THE DELETION OF DEPARTMENT OF AGRICULTURE (DA) AND DEPARTMENT OF AGRARIAN REFORM (DAR) CERTIFICATIONS IN THE LIST OF DOCUMENTARY REQUIREMENTS PRESCRIBED IN THE APPROVED GUIDELINES FOR PLAN, REVIEW, ADOPTION AND APPROVAL PROCESS
In view of the reported difficulties encountered by the local government units in securing DA and DAR certifications prior to review/approval of CLUP/ZO causing delay in CLUP/ZO approval and compliance to presidential directives on CLUP preparation; the NLUC having agreed after a series of special meetings to delete the DAR and DA certifications as requirements for the CLUP review/approval, the Board of Commissioners adopted on 21 May 2001, the subject resolution:
WHEREAS, the Guidelines for Plan Review, Adoption and Approval Process for Component Cities and Municipalities; Highly-Urbanized Cities and Independent Component Cities; Cities and Municipalities of Metro Manila and Provinces were approved per Board Resolutions Nos. 561 & 569 s. 1995 & 577 s. of 1996 and subsequently consolidated into Volume IX of the Guidelines for the Formulation/Revision of Comprehensive Land Use Plans approved per Board Resolution No. 637, S. of 1999;
WHEREAS, the same guidelines require submission of DA and DAR Certifications as part of the documentary requirements for review and approval of Comprehensive Land Use Plans (CLUPs) and Zoning Ordinances (ZOs);
WHEREAS, Republic Act (RA) 8435 otherwise known as the “Agriculture and Fisheries Modernization Act of 1997” was signed into law in 22 December 1997 and became effective in February 9, 1998;
WHEREAS, Section 10 of RA 8435 provides that within one (1) year from the finalization of the Strategic Agriculture and Fisheries Development Zones (SAFDZ) in every city and municipality, all cities and municipalities shall have prepared their respective land use plans and zoning ordinances incorporating the SAFDZs;
WHEREAS, Board Resolution No. 628 s. of 1998 provides the Guidelines for the incorporation of SAFDZs in the enactment and updating of LGU land use and zoning plans and ordinances;
WHEREAS, the President issued several directives relative to the finalization of CLUPs by local government units;
WHEREAS, the LGUs have difficulty complying with the requirements to submit DA and DAR Certifications causing delay in the approval of CLUPs and subsequent compliance to the said directives;
WHEREAS, the members of the National Land Use Committee (NLUC) in its meeting on 17 April 2001 agreed to delete the DA and DAR Certifications as requirements for the CLUP review/approval.
WHEREFORE, BE IT APPROVED AS THE SAME IS HEREBY APPROVED, that DA and DAR Certifications be deleted from the list of documentary requirements prescribed in the Guidelines for Plan Review, Adoption and Approval Process.
