[ DDB BOARD REGULATION NO. 1, January 11, 1990 ]

AUTHORITY TO CHARGE FEES FOR DRUGS DEPENDENCY EXAMINATIONS



Pursuant to the rule-making powers vested in the Dangerous Drugs Board under Section 36(a), Article VIII in relation to Section 30, Article VI of Republic Act Numbered 6425, as amended, in relation to the provisions of Section 572 of the Revised Administrative Code, and of Sections 40 and 52 of Presidential Decree No. 1177, the Budget Reform Decree of 1977, the following are hereby prescribed:

SECTION 1.       The fees for drug dependency examination shall be in accordance with the rates prescribed by the Board as shown in Annex "A" hereof.

SECTION 2.       Any person who avails himself of the complete drug dependency examination shall pay all the fees therefor.  However, if only one (1) examination is undertaken on the person himself or on his specimen, the fee corresponding to such examination shall be paid.

SECTION 3.       Persons who are covered by court referrals or those arrested pursuant to section 24-A of Republic Act No. 6425, as amended, are exempt from the payment of the above prescribed fees.

An Indigent patient shall, likewise, be exempt from the payment of the above fees if he submits satisfactory proof of his indigence, pursuant to Rule 3, Section 22 of the Revised Rules of Court, quoted below as follows:

"Section 22.  Pauper Litigant — Any court may authorize a litigant to prosecute his action or defense as a pauper upon a proper showing that he has no means to that effect by affidavits, certificate of the corresponding provincial, city or municipal treasurer, or otherwise.X.X.X"

SECTION 4.       This Regulation shall take effect after the completion of its publication once a week for two (2) consecutive weeks in a newspaper of general circulation.
