[ HLURB ADMINISTRATIVE ORDER NO. 09, S. 2000, November 13, 2000 ]

RESOLUTION NO. R-677, ALLOWING THE PROCESSING OF APPLICATIONS FOR CERTIFICATE OF REGISTRATION AND LICENSE TO SELL PENDING THE RELEASE OF ENVIRONMENTAL COMPLIANCE CERTIFICATE (ECC) FROM EMB, DENR AND APPROVED SURVEY PLAN FROM LMB, DENR



With reference to the status of implementation of EO 258 (Time Standards in the Issuance of Permits to Housing Projects), the above subject resolution was approved by the Board allowing a parallel processing of application for Certificate of Registration (CR) and License to Sell (LS) with HLURB, and the ECC and Subdivision Survey Plan approved by DENR, to shorten the 30-day processing period. Quoted hereunder is the text of the said resolution:
"WHEREAS, the Office of the President has issued Executive Order No. 258 entitled ‘Prescribing Time Standards in the Issuance of Permits for Housing Projects’;

WHEREAS, under EO 258, the Housing and Land Use Regulatory Board (HLURB) was directed to adopt a 30-day processing period in the issuance of Certificates of Registration (CR) and Licenses to Sell (LS) upon receipt of completed application;

WHEREAS, among the requirements for submission are Approved Survey Plan of the subdivision project and Environmental Compliance Certificate (ECC) issued by the DENR;

WHEREAS, the entire housing approval system could be further shortened via a parallel processing of clearances/approvals with the DENR and HLURB;

WHEREAS, the Subdivision and Housing Developers Association has requested and proposed that application for CR and LS be accepted by HLURB for processing meantime their application for ECC and application for approval of survey plan with the EMB and LMB of DENR are being processed.  It is understood that HLURB will not be in default of the 30-day standard and under no obligation to approve the CR/LS unless the required approved survey plan and ECC are submitted.

WHEREFORE, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that the processing of application for CR/LS shall be allowed pending the release of ECC from EMB, DENR and Approved Survey Plan from LMB, DENR provided that the HLURB shall be under no obligation to approve the application unless the required approved survey plan and ECC are submitted.
