[ PRC RESOLUTION NO. 377 SERIES OF 1995, September 19, 1995 ]

AMENDMENT OF RESOLUTION NO. 225 SERIES OF 1992



WHEREAS the Professional Regulation Commission (for short Commission) issued Resolution No, 225 Series of 1992 which proscribes Chairpersons and Members of the Boards from seeking elective or appointive positions in professional organizations accredited by the Professional Regulation Commission;

WHEREAS Executive Order No. 496 disqualifies incumbent national officers (President, Vice President, Secretary, Treasurer and Press Relations Officer or their equivalent positions) of accredited associations from being nominated for appointment to the professional regulatory Boards;

WHEREAS the incumbent national officers of accredited associations are disqualified from nomination in order to prevent any undue advantage which incumbent national officers may enjoy over nominees who are not incumbent officers;

WHEREAS Chairpersons and Members of the boards have been appointed on the basis of, among others, their impeccable integrity and would not therefore engage in any conduct which might compromise their personal integrity or of the licensure examinations;

WHEREAS the holding of simultaneous positions In the accredited association and the Board does not necessarily generate conflict of interest but may instead promote the advancement of the profession specially for a Chairperson or Board Member whose term of office is expiring during his term of office as a national officer of an accredited organization;

WHEREAS the Commission under Section 5(m) of PD 223 does have the power to “exercise general supervision” over the members of the various Boards;

NOW, THEREFORE, the Commission, by virtue of Section 5 (m) of P.D. 223, hereby resolved as it so resolves, to amend Resolution No. 225, Series of 1992, such that the proscription contained therein does not apply to a Chairperson or Board Member whose term of office as such Chairperson or Board Member is expiring during his term of office as a national officer of an accredited organization provided that such Chairperson or Member shall be considered IPSO FACTO as having resigned from his Chairmanship or Membership in the Board upon taking his oath as an officer of the professional organization.
