[ PRC BOARD FOR PROFESSIONAL TEACHERS RESOLUTION NO. 02, SERIES OF 1995, December 29, 1995 ]

PRESCRIBING FEES FOR REGISTRATION WITHOUT LICENSURE EXAMINATION AS PROFESSIONAL TEACHER UNDER CATEGORIES (A) AND (B) OF THE SECOND PARAGRAPH OF SEC. 26, ARTICLE III OF R.A. 7836



WHEREAS, the second paragraph of Sec. 26, Art Ill of No.7836, otherwise known as the “Philippine Teachers Professionalization Act of 1994” states:

“Upon approval of the application and payment of the prescribed fees, the certificate of registration and professional license as professional teacher shall be issued without examination as required in this act to a qualified applicant, who at the time of the approval of this act (December 16, 1994) is:

(a)          A holder of a certificate of eligibility as a teacher issued by the Civil Service Commission and the Department of Education, Culture and Sports; or

(b)          A registered professional teacher with the National Board for Teachers under the Department of Education, Culture and Sports pursuant to Presidential Decree No. 1006";

WHEREAS, Sec. 6 (d), Art. II of R.A. No. 7836 empowers the Board for Professional Teachers (hereinafter called the Board) to prescribe and collect examination and other fees as it may deem proper;

WHEREAS, the Professional Regulation Commission (hereinafter called Commission) under Sec. 5 (g) of P.D. No. 223, as amended, is likewise empowered to determine, fix and collect the amount to be charged for examination, registration, registration without examination, licenses, annual registration fees, certifications, surcharges and other fees not specified under the provisions of R.A. No. 6511, or amend the rates provided thereunder subject to approval by the Office of the President;

WHEREAS, under Sec. 5, Art. II of R.A. 7836, the Board is a collegial body under the general supervision and administrative control of the Commission;

WHEREAS, as provided in the second paragraph of Section 26 of R.A. No. 7836, the applicants for registration in Category A are holders of certificates of eligibility as teachers issued by the Civil Service Commission and the Department of Education, Culture and Sports while in category B, the applicants are registered professional teachers and as such, they should not be treated as initial registrants in the profession as would place them within the ambit of the Resolution of the Commission fixing the rates, of registration of all professions; and

WHEREAS, the registration fee that should therefore be collected from such registrants should be that which could cover only the cost of the Certificate of Registration.

NOW, THEREFORE, pursuant to Sec. 6(a) of R.A. No. 7836, the Board RESOLVED, as it hereby RESOLVES, to prescribe the fee of THIRTY (P30.00) Pesos for applicants for registration without examination as Professional Teacher under categories A and B of the second paragraph of Sec. 26, Art.  III of R.A. No. 7836 for the issuance of the Certificate of Registration to the registrant, and the amount of One Hundred Twenty (P120.00) Pesos as license fees for three (3) years for the issuance of a Professional License to the said professional teachers which shall be collected by the Commission.

RESOLVED, FURTHER, that this Resolution, after its approval by the Commission, shall be published and shall become effective after fifteen (15) days following its publication in a newspaper of general circulation and the Official Gazette, whichever is earlier.

RESOLVED, FINALLY, that this Resolution be widely disseminated to all schools, colleges, universities and other institutions of learning, public and private, through the Commission on Higher Education (CHED) and the Department of Education, Culture and Sports (DECS).
