[ CESB RESOLUTION NO. 471, February 18, 2003 ]

AMENDMENT TO SECTION 4, ARTICLE II OF THE REVISED RULES ON CAREER EXECUTIVE SERVICE (CES) ELIGIBILITY



WHEREAS, Presidential Decree No. 1 dated September 24, 1972, created the Career Executive Service Board (CESB) to serve as the governing body of the Career Executive Service (CES) and mandated it to promulgate rules, standards and procedures on selection, classification, compensation and career development of members of the Career Executive Service;

WHEREAS, paragraph 5 (a) of the same law explicity provides that "a person who meets such management experience and other requirements and passes such examinations, as may be prescribed by the Board, shall be included in the register of career executive eligibles;"

WHEREAS, in accordance with the provisions of the aforementioned law, the Board passed CESB Res. No. 459, s. 2002 and a corresponding circular (CESB Cir. No. 1, s. 2003) laying down the new rules and procedures in the Career Executive Service (CES) Eligibility;

WHEREAS, Section 4 Article II of the aforequoted policy expressly provides that "for purposes of assignment to CES positions or appointment to CES ranks, all other government examinations administered by agencies mandated by law to conduct government examinations shall not be equivalent to the Career Executive Service Eligibility Examination conducted by the Board;"

WHEREAS, it is deemed necessary to amend the said provision to clarify that its intent was to convey that rank could only be attained via the CES eligibility process and through no other government examinations.

NOW, THEREFORE, foregoing premises considered, the Board RESOLVES, as it is hereby RESOLVED, that Section 4, Article II of the Revised Rules on Career Executive Service (CES) Eligibility (CESB Resolution 459, s. 2002 dated October 8, 2002) is hereby amended to read as follows:

"Section 4. CES Eligibility an Exclusive Requirement for Appointment to CES Ranks. Only a CES Eligible, upon conferment of CES Eligibility by the Board, and assignment to a CES position by the President or the appropriate appointing authority, shall be appointed to a CES rank by the President upon the recommendation of the Board. For this purpose, no other government examinations could substitute the CES eligibility process given by the Board for rank appointment."

RESOLVED FURTHER, that this resolution shall take effect fifteen (15) days after its publication in the Official Gazette or in a newspaper of general circulation in the Philippines.
