[ LTFRB MEMORANDUM CIRCULAR NO. 2000-021, December 29, 2000 ]

APPLICATIONS FOR APPROPRIATION OF ABANDONED AND EXPIRED CERTIFICATES OF PUBLIC CONVENIENCE



In view of the number of applications/petitions for appropriation of abandoned and/or expired Certificates of Public Convenience, the Board has resolved to review the acceptance of said applications/petitions.

Pending the review of the said practice and until further orders, the Board hereby directs:
1.      No application/petition for appropriations/petition of abandoned Certificates of Public Convenience (CPCs) will henceforth be accepted for filing:

2.      Pending applications/petitions for appropriation of CPCs which have already expired when the said applications/petitions were accepted are hereby dismissed;

3.      Pending applications/petitions for appropriation of CPCs that are valid and subsisting when the applications/petitions were accepted for filing will be suspended pending determination of the Route Measure Capacities of the routes applied for by the Technical Working Group pursuant to existing policies;

4.      Pending applications/petitions for appropriation already submitted for decision will be resolved in accordance with the evidence submitted by the parties and the Route Measured Capacity on the routes subject of the applications/petitions.
This Memorandum Circular takes effect immediately.
