PENALTIES FOR MULTIPLE MARKINGS AND PLACING OF NAME IN THE SPACE PROVIDED FOR THE SUBJECT OF THE EXAMINATION



WHEREAS, one of the powers, functions and responsibilities of the Commission as provided for under Section 7 (d) of Republic Act Number 8981 is "[T]o administer and conduct the licensure examinations of the various regulatory boards in accordance with the rules and regulations promulgated by the Commission; and impose the penalty of suspension or prohibition from taking licensure examinations to any examinee charged and found guilty of violating the rules and regulations governing the conduct of licensure examinations promulgated by the Commission;"

WHEREAS, the Commission has observed that cases for violation of instruction by examinees of the GENERAL INSTRUCTIONS TO EXAMINEES printed at the back of the NOTICE OF ADMISSION given to each and every examinee for their guidance and compliance and are brought before the Commission for decision are now dispatched more expeditiously;

WHEREAS, the penalty that should be imposed for the placing of name in the space provided for the subject of the examination shall be, aside from the cancellation of the examination papers, suspension from taking the examination for one (1) year;

WHEREAS, the penalty that should be imposed for multiple markings shall be cancellation of the examinees examination and suspension from taking the examination for two (2) years.

WHEREFORE, the Commission resolves as it is hereby resolved that the penalty for placing of name in the space provided for the subject of the examination in the answer sheet shall be suspension from taking the examination for a period of one (1) year and for multiple markings, the penalty shall be suspension from taking the licensure examination for a period of two (2) years.

FURTHER RESOLVED, that the examination papers of the examinees who committed violation of instructions to examinees shall be cancelled.
