[ DDB BOARD REGULATION NO. 2, s. 1981, August 19, 1981 ]

PRESCRIBING THE MODE OF PAYMENT OF INFORMERS' REWARDS, LIMITING THE GRANT THEREOF TO INSTANCES WHERE A CASE IS FILED IN COURT



Pursuant to the powers vested in the Dangerous Drugs Board under Section 36 (a) and (o) of Republic Act 6425, as amended, and in accordance with the decision of the Board arrived at in its meeting of July 21, 1981, the following regulation is hereby prescribed:

SECTION 1.       The mode of payments for informers' rewards shall be as follows:

a.       50% of the reward shall be given after the case is docketed in the proper court; and

b.       50% after the prosecution rests its case, as certified to by the Clerk of Court.

SECTION 2.       No reward shall be granted to an informer whose information is instrumental in the discovery and seizure of marijuana or other wild or illicit growth of plants from which dangerous drugs may be extracted if no apprehension of the violator is effected.  Apprehension as herein used shall be construed as effective custody of the violator.

SECTION 3.       All Board Regulations or portions thereof inconsistent herewith are superseded.

SECTION 4.       This Regulation shall take effect after fifteen (15) days following the completion of its publication in the Official Gazette.
