[ IPO MEMORANDUM CIRCULAR NO. 02, September 08, 2000 ]

GRANT FOR THE REQUEST FOR EXTENSION OF TIME FOR UM/ID FILED/PROSECUTED UNDER R.A. 8293 AND PROCESSED PRIOR TO THE EFFECTIVITY OF OFFICE ORDER NO. 09



Subject to the compliance with the requirements under Rule 452 (b) (Office Order No. 09: "Amendments to the Rules and Regulations on Utility Models and Industrial Design"), the request for extension of time to reply to an office action filed prior to June 01, 2000 (effectivity of Office Order No. 09) is hereby granted, provided, that said request for-extension of time was filed within the prescribed period for which a response to an office action should have been filed.

Consequently, all utility model and industrial design applications filed/prosecuted under R.A. 8293 and processed prior to the effectivity of Office Order No. 09, shall be deemed withdrawn in either of the following cases as hereunder provided, to wit:

a)    When the applicant/s has failed to file a response to an outstanding office action before the expiration of the extension of time to reply (Rule 452 [b]); or

b)    When the request for an extension of time was filed out of time.

A withdrawn application may be revived in accordance with Rule 453 (Office Order No. 09).

Mr. Eduardo Joson, Records Officer II, is hereby directed to immediately file three (3) certified copies of Memorandum Circular with the University of the Philippines Law Center.

This Memorandum shall take effect immediately.
