AMENDMENTS TO SECTIONS 113(8) AND 109 (9) — SUDDEN REVERSAL OF FORM AND OUT OF CONDITION HORSES



Please be informed that the Philracom Board in its meeting on September 1, 2000 resolved to amend Sections 113(8) and 109 (9) of the Horse Racing Rules and Regulations, to wit:

8.1    In rendering a decision, the Stewards shall take into account as far as practicable the following: track condition; the performance of the horse IN THE SAME TRACK WITHIN THE PAST FOUR (4) WEEKS compared to the present performance; the time difference should be four (4) seconds or more for a horse to be considered for sudden reversal of form; the class or grouping of the compared to the previous company; the present condition, characteristics, including sex and age, and running style of the horse; the trip of the horse in the course of the race or how the race was run by a particular horse; the jockey’s class, ability and riding style; the testimony of the jockey; the current handicap weight compared to the previous weight carried by the horse; and the weather condition at the time the race was run.

8.2    This rule shall apply to horses which came in from a win, place or show (1st, 2nd or 3rd) within the past four (4) weeks, and exhibited poor performance, except for horses in the Maiden Division and those that have only won in or renounced from the Maiden Division and have not won in any other race.

8.3    The trainer or the owner should be summoned by the Stewards before the next race to explain the performance of his horse before a decision is made.

Section 109 (9) shall now read as follows:

Section 109 (9.0) — Horses found out of condition shall be given the following suspension :

1st offense — one (1) month
2nd offense — two (2) months
3rd offense — four (4) months
4th offense — six (6) months
5th offense — banned

The previous out of condition offense shall be negated if a horse runs for at least six (6) times for a period of one (1) year without being out of condition.

9.1     The same criteria for sudden reversal of form, Section 113 (8.1), to a lesser degree, shall apply, including those not covered by Section 113 (8.2).

9.2     The trainer or the owner should be summoned by the Stewards before the next race to explain the performance of his horse before a decision is made.

The approved IMPLEMENTING GUIDELINES for these rules are in the APPENDIX.

These rules shall take effect immediately.
