[ LTFRB MEMORANDUM CIRCULAR NO. 2000-019, September 13, 2000 ]

ACCEPTANCE OF APPLICATION FOR THE LEGALIZATION OF OPERATIONS OF TAXI UNITS WITHIN BAGUIO CITY WHICH WERE ISSUED FRANCHISES IN VIOLATION OF THE PROVISIONS OF C.A. 146 AS AMENDED KNOWN AS THE “PUBLIC SERVICE ACT”



In view of the need to legalize  the operation of taxi units within the City of Baguio, whose, operators were issued CPC in violation of the provisions of C.A. 146 as amended and its implementing Rules and Regulation and in view of the request of the City Council of Baguio City to address the problem taking into consideration the economic, social implications and for the efficient regulation of these vehicles within the City, LTFRB Region 1 is hereby directed to accept process and approve such applications subject to the following conditions:

1.         That the applicants shall be based and limited to the records of LTFRB Region 1, Endorsement of the Council of Baguio;

2.         That the applicant shall be assessed and will be required a filing fee of P430.00 and a penalty of P200.00/mo. for illegal operation reckoning from date of issuance of the questioned franchise;

3.         That the procedure for accepting, processing and evaluation shall be that of a new application for franchise;

4.         That the unit/s of the application for legalization shall be the same unit subject of the questioned franchise;

5.         That no Dropping and Substitution, Sale and Transfer, Assignment, Lease or other form of transfer shall be allowed within one (1) year from date of approval;

6.         That the acceptance of the application shall be within  30-days from the effectivity of this circular.

This Memorandum Circular shall take effect  fifteen (15) days after filing of three (3) copies with the U.P. Law Center in accordance with Presidential Memorandum Circular No. 11 dated October 9, 1992, and any and all issuances inconsistent herewith are hereby modified accordingly, superseded and/or revoked.
