The subject Resolution which was adopted by the Board on 09 October 1995 renders the process of ratifying the CLUPs of Metro Manila cities and municipalities, highly urbanized and independent component cities and provinces by the Board of Commissioners uniform via an amendment in the pertinent procedure in each set of guidelines.

The same resolution is quoted hereunder:

“WHEREAS, the guidelines for the review and approval of Comprehensive Land Use Plans (CLUPs) for Metro Manila cities/municipalities and highly urbanized and independent component cities were approved under Resolution No. R-561 dated 21 November 1994 and promulgated under HLRB Administrative Order No. 01, Series of 1995;

WHEREAS, the said guidelines do not detail the ratification procedure to be executed by the Board of Commissioners;

WHEREAS, the detailed guidelines on the Board of Commissioners’ ratification action is delineated in the ratification process for provincial plans as approved under Resolution No. R-569 dated 20 March 1995 and promulgated under HLRB Administrative Order No. 3, Series of 1995; and

WHEREAS, a uniform ratification process by the Board for the CLUPs of Metro Manila cities/municipalities, highly urbanized and independent component cities, and provinces will support and facilitate both the ends of compliance and implementation;

WHEREFORE, be it RESOLVED, as it is hereby RESOLVED, that the pertinent portions of the process be amended to read as follows:

GUIDELINES FOR THE REVIEW AND APPROVAL OF COMPREHENSIVE LAND USE PLANS OF METRO MANILA CITIES/MUNICIPALITIES

5. HLRB (FOSG)

5.1 Receives plan documents and checks completeness

5.2 Prepares review/recommendation report and Board Resolution approving the plan.

5.3 ENDORSES TO HLRB BOARD THROUGH THE BOARD SECRETARIAT FOR APPROVAL

5.4 INVITES CITY/MUNICIPAL MAYOR OR HIS DULY AUTHORIZED REPRESENTATIVE AND THE HLRB REGIONAL OFFICER TO ATTEND THE BOARD MEETING TO PRESENT THE PLAN AND THE LATTER TO ACT AS A RESOURCE PERSON.

7. FOSG

7.1 Receives documents and checks its completeness.

7.2 Conducts review and recommends the plans for ratification BY THE BOARD THROUGH THE SECRETARIAT

7.3 INVITES THE CITY MAYOR OR HIS DULY AUTHORIZED REPRESENTATIVE AND THE HLRB REGIONAL OFFICER TO ATTEND THE BOARD MEETING, THE FORMER TO PRESENT THE PLAN AND THE LATTER TO ACT AS A RESOURCE PERSON.

6. HLRB (Central Office-

6.5 Invites the Provincial Governor OR HIS DULY FOSG AUTHORIZED REPRESENTATIVE and the HLRB Regional Officer to attend the Board Meeting, the former to PRESENT the plan and the latter to act as resource person.

Be it further RESOLVED, as it is hereby RESOLVED, that the flowcharts of the guidelines for the review and approval process be correspondingly amended to constitute Annex A of this Resolution.”

Annex A^* which is appended hereto gives the flowchart for each of the local government unit concerned.
