[ POEA GOVERNING BOARD RESOLUTION NO. 01, S. 2000, December 19, 2000 ]
LICENSING, PROJECT REGISTRATION AND WORKERS' DOCUMENTATION OF POCB-REGISTERED COMPANIES AT POEA
WHEREAS, Rule 1, Section 1 of the Rules and Regulations Governing Overseas Employment, as amended, has set the requirements for the issuance of license/authority for the private sector, including construction-contractor companies;
WHEREAS, Part IV, Section 7 of the Implementing Rules and Regulations of the Migrant Workers and Overseas Filipinos Act of 1995 or Republic Act 8042, provides that the Philippine Overseas Employment Administration (POEA) shall come up with a package of incentives for deserving service contractors along with the policy that the deployment of workers by such entities shall also be encouraged;
WHEREAS, all construction contractor-companies registered at the Philippine Overseas Construction Board (POCB) undergo strict and rigid registration requirements;
WHEREAS, all workers under the employ of POCB-registered construction companies are local employees enrolled with the Social Security System (SSS) and are entitled to all other benefits accorded to local employees of POCB-registered construction companies;
WHEREAS, there is a need to adopt new guidelines to facilitate the licensing of POCB-registered companies and the mobilization of Overseas Filipino Workers (OFWs) hired by them;
NOW, THEREFORE, the POEA Governing Board, in a meeting duly convened, hereby resolves to adopt a simplified licensing, project registration and workers' documentation of POCB-registered companies at POEA under streamlined procedures, taking into consideration the registration process they undergo at the POCB.
