Training Period of Understudies of Alien Employees Amending Certain Provisions of Department Order No. 5 Series of 1989



In order to achieve synchronization of the periods of allowable stay of expatriate workers previously prescribed under Department Order No. 5, series of 1989, with the periods prescribed by similar issuances in other government agencies, the following guidelines are hereby issued and promulgated for the information and guidance of all concerned:

Paragraph 6 of Department Order No. 5, series of 1989 is hereby amended to read as follows:

“6 .  Duration of the Understudy Training Program

6.1    Training for understudies of aliens occupying technical positions shall be undertaken within a period of two (2) years from the date of the issuance of the original alien employment permit.  Annual extensions may be allowed only for justifiable reasons as set forth in paragraph 7 hereof but in no case shall such extension exceed three (3) years.

6.2    Training for understudies of aliens occupying supervisory positions shall be undertaken within a period of three (3) years from the date of issuance of the original alien employment permit.  Annual extensions may be allowed only for justifiable reasons as set forth in paragraph 7 hereof but in no case shall such extension exceed two (2) years.

6.3    Training for understudies of aliens occupying advisory positions shall be co-terminus with the employment contract of the alien but not exceeding three (3) years from the date of the issuance of the original alien employment permit.  Annual extensions may be allowed only for justifiable reasons as set forth in paragraph 7 hereof but in no case shall such extension exceed two (2) years.”

2.  Repealing Clause – All guidelines, rules and regulations inconsistent herewith are repealed or modified accordingly.

3.  Effectivity – These guidelines shall take effect immediately.
