[ NTC MEMORANDUM CIRCULAR NO. 7-6-96, June 17, 1996 ]

IMPLEMENTING GUIDELINES OF MEMORANDUM CIRCULAR NO. 4-3-96



Pursuant to the provisions of M.C. No. 4-3-96 concerning the operation of spread spectrum technology, the following guidelines for the licensing of radio equipment using spread spectrum technology are hereby issued:

1. The authorization for the sale, importation and operation of spread spectrum technology radio equipment shall be limited to operate within the frequency bands 915-928 Mhz, 2400-2483.5 Mhz and Mhz 5725-5850.0 Mhz and shall not exceed one (1) watt effective radiated power (ERP).

2. The equipment shall be type-approved or type-affected by the Equipment and Standards Division of the Commission prior to licensing.

3. Applicants desiring to obtain the necessary permits and licenses for these equipment shall file in the prescribed form with the appropriate licensing units of this Commission.

4. Operation of the radio equipment(s) using spread spectrum technology shall be on a secondary, non-priority and non-interference basis.

5. The operation and maintenance of the entire spread spectrum network shall be handled by at least one (1) radio technician who is a holder of a valid first class commercial radio telephone operator certificate under the supervision of a licensed Electronics and Communications Engineer, except for cordless telephone which shall conform with NTC MC No. 7-07-86.

6. The Commission reserves the right to cancel, suspend or revoke the issued license should the radio station network cause harmful interference and shall not resume operation until the harmful interference has been corrected.

Any circular, order, memoranda or part thereof which is inconsistent herewith shall be deemed superseded, amended, or repealed.

This circular takes effect within fifteen (15) days publication and shall remain valid unless otherwise amended, revised or revoked.
