[ LTFRB MEMORANDUM CIRCULAR NO. 2005-001, January 18, 2005 ]

AMENDMENT TO MEMORANDUM CIRCULAR NO. 2004-011, AS AMENDED



After a careful evaluation of the recommendations by the Department of Tourism (DOT) in reference to Memorandum Circular 2004-011 (Re: Reclassifying Tourist Transport Services), dated 26 May 2004, the Board hereby amends the following provisions of the said Circular as follows:

 

A) Item 3 of page 2 shall read, thus:

 

"Tourist Rent-A-Car Transport Service refers to four-door sedan vehicles, pick-ups, vans, and luxury vehicles. Luxury vehicles are vehicles provided with plush marketing, luxurious upholstery and premium sound system with engine displacement of not less than 2,000 cc and have a wheel base of not less than 2,670 mm such as sports utility vehicles, limousines or their equivalent. These luxury vehicles must have no body markings."

 

B) Last paragraph of page 2 shall now read, thus:

 

"Likewise, LTFRB shall allow duly accredited accommodation establishments of the DOT to use a maximum of two (2) units (sedans, vans, coasters) without franchise/CPC solely dedicated for in-house shuttle service of establishments' guests and customers, provided that their use is free of charge and provided further, the establishment's name/identification/markings/logos are printed on both sides of the vehicle's body. The excess of said number of units shall be subject to regular LTFRB tourist transport franchising process."

 

C) Lastly, first paragraph of page 3 shall now read, thus:

 

"The age requirement for all units for the above transport services is ten (10) years from date of manufacture, except for coasters, mini-buses and buses which is fifteen (15) years."

It is reiterated, however, that Paragraph "C", above, only applies to existing authorized units. In cases of new Applications, Increase of Units, Dropping and Substitution of Units, brand new units shall still be required.

This Memorandum Circular supersedes any and all issuances inconsistent herewith, and take effect immediately following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No.11, dated 09 October 1992.
