(NAR) VOL. 15 NOS. 3-4 / OCTOBER - DECEMBER 2004

[ BI MEMORANDUM ORDER NO. AFF-04-023, November 16, 2004 ]

It appears that on 1 October 1999 the Honorable Department of Justice approved a revised schedule of immigration fees for this Bureau.  This revised schedule provides, among others, the collection of the following fees for Petitions for Deportation:
i) Application fee -
ii) Implementation fee - P2,000.00; and
iii) Service fee - P1,000.00.

To maximize revenue-generating efforts and to deter private individuals from filing deportation complaints before this Bureau that are substantively trivial, frivolous and vexatious or initiated in evident bad faith, the preceding fees shall henceforth be assessed and collected for Petitions for Deportations.

However, the following complaints/petitions for deportation shall be exempt from the assessment and collection of the preceding fees:

1. Those pursuant to an order issued by the President;
2. Those pursuant to an order issued by the Secretary of Justice;
3. Those pursuant to a final judgement for a crime or an offense; and
4. Those pursuant to an official request by the ambassador, consul-general or a duly authorized representative of a foreign embassy.

A copy of the revised schedule of fees is attached as Annex "A"*, for reference purposes.

This memorandum order shall take effect immediately.

Adopted: 16 Nov. 2004
