[ SRA CIRCULAR LETTER NO. 14, January 09, 1996 ]

IMPLEMENTING GUIDELINES FOR THE RECLASSIFICATION OF "D" WORLD MARKET SUGAR INTO "B" DOMESTIC MARKET SUGAR



Pursuant to SRA Sugar Order No. 6, Series of 1995-1996, dated 22 December 1995, the following guidelines for the reclassification of Crop Years 1992-1993 and 1993-1994 "D" or World Market Sugar into "B" or Domestic Market Sugar, are hereby promulgated for the guidance of all holders of outstanding "D" Sugar quedan-permits and parties who withdraw "D" Sugar from mill warehouses but cannot present proof of export to the world market nor legitimate sale to bonafide processors of sugar-based export products, to wit:

Application Form to Use


All applicants, holders of outstanding Crop Years 1992-1993 and 1993-1994 "D" sugar quedan-permits and those who had withdrawn "D" sugar of said crop years from mill warehouses but cannot present proof of export to the world market nor legitimate sale to bonafide processors of sugar-based export products, shall accomplish completely and accurately the attached forms entitled "Application for Reclassification of "D" World Market Sugar into “B” Domestic Market Sugar" (SRA Form D-B) and "Application for Reclassification of Withdrawn "D" World Market Sugar (Without Proof of Export to the World Market nor Legitimate Sale to Food Exporters] into “B” Domestic Sugar (SRA Form D-W), respectively, said forms to be duly notarized.

The applicant shall list in the said application form his "D" Quedan-Permits, whether original "D" or "swapped" and surcharged into "D", by sugar mill and by crop year, indicating the following:

a. Quedan number arranged sequentially.

b. Corresponding quantity of sugar in LKg.-Bags.

If a separate list of "D" quedan-permits is attached to the application form said list shall be certified as to correctness by the applicant.

The applicant, in the case of holders of outstanding "D" World Market quedan-permits, shall likewise attach to the application form his sugar quedan-permits corresponding to the said list of outstanding quedan-permits.

II

Price Differential

Upon filing of the application for reclassification with the SRA, the applicant shall pay a "Price Differential" of P175 per Lkg. — Bag.

Should there be any question as to the volume of sugar subject to such payment of the "Price Differential", the SRA shall resolve the issue based on its audited records and any addition, based on SRA's records, to the total quantity of "D" Sugar declared in the application for reclassification will also subject said additional quantity of "D" Sugar to reclassification and payment of the corresponding "Price Differential" as prescribed by Sugar Order No. 6, Series of 1995-1996.

The SRA shall issue an "Authority to Accept Payment" to the applicant addressed to a Depository Bank, advising the said bank to accept payment of the total "Price Differential" due from the applicant.

The "Authority To Accept Payment" form shall be duly signed by the Administrator or by his authorized representative/s.

III

Approval of Application for Reclassification by SRA


The approval of the application for reclassification by the SRA shall be done upon presentation of proof of payment of the "Price Differential (Official Receipt of the Depository Bank), which payment shall not be later than ten (10) days after issuance of Authority to Accept Payment.

Once the application of the holder of outstanding "D" Quedan Permits has been approved by SRA, the "D" Sugar Quedan-Permits, whether original or "swapped" and surcharged into "D", shall be deemed reclassified, such that, said Quedan-Permits shall be properly stamped "RECLASSIFIED AS "B" DOMESTIC MARKET SUGAR", in which case a Letter Authority addressed to the concerned sugar mill shall be issued by the SRA allowing withdrawal of the "D" World Market Sugar as "B" Domestic Market Sugar after the corresponding liens reflected in the quedan-permits have been paid to the Philippine National Bank.

IV

Failure to File and Application for Reclassification


Any party who shall fail to file an application for reclassification on or before the deadline stated in Sugar Order No. 6, Series of 1995-1996, or files an inaccurate application, shall, upon being required to do so by SRA, show cause why he should be exempt from the requirement. If found to be accountable, said party shall pay an additional "Price Differential" of P25.00 per Lkg.—Bag.

Deadline of Filing the Application For Reclassification


The deadline for the filing of the application for reclassification shall be not later than 26 January 1996.

This Circular Letter shall take effect immediately.
