AMENDMENT TO MEMORANDUM CIRCULAR NO. 2006-059 DATED 14 AUGUST 2006 [RE: IMPLEMENTATION OF PUBLIC UTILITY JEEPNEY (PUJ) “COLORUM” LEGALIZATION PROGRAM IN CRITICALLY-IDENTIFIED ROUTES NATIONWIDE]



After consultation with representatives from various transport groups, the Board hereby amends Memorandum Circular No. 2006-059 with respect to the fine/penalty to be imposed in connection with the implementation of the “Colorum” Legalization Program. Accordingly, the fine/penalty for PUJs plying routes considered and defined as “developmental” shall only be the amount equivalent to the regular filing fee for any application for issuance of a new certificate of public convenience.

For purposes of this memorandum circular, a “developmental route” is defined as

a route that handles light density traffic. This route is necessarily developmental, either because there is no existing authorized operator serving the unserved feeder portion of at least 20 kilometers distance that links to the presently served trunkline route; or it has residential, tourist, commercial/industrial potentials, or it needs developed areas for its subsistence and development. Initial operation along this route is economically, politically and socially desirable but not necessarily financially viable.

This Memorandum Circular supersedes any and all issuances inconsistent herewith and shall be effective fifteen (15) days after its publication in a newspaper of general circulation or in the Official Gazette.
