[ BSP CIRCULAR NO. 1339, May 18, 1992 ]
AMENDMENT TO BOOK II OF THE MANUAL OF REGULATIONS FOR BANKS AND OTHER FINANCIAL INTERMEDIARIES
The Monetary Board, in its Resolution No. 275 dated March 20, 1992, approved the following amendments to Book II of the Manual of Regulations for Banks and Other Financial Intermediaries:
1. The first paragraph of Subsec. 2161.1 and item (a) thereof are hereby amended to read as follows:
4. Subsec. 2161.7 is hereby amended to read as follows:
7. Subsec. 2161.13 on the submission of reports of stockholders/board of directors’ resolutions is hereby deleted.
8. Subsec. 2331.3 is hereby amended to read as follows:
10. Appendix 3 on Reports Required of Thrift Banks, consisting of thirteen (13) pages shall be superseded by the revised Appendix 3 [*].
This Circular shall take effect immediately.

1. The first paragraph of Subsec. 2161.1 and item (a) thereof are hereby amended to read as follows:
"2161.1 Categories and signatories of bank reports — For purposes of designating the signatories thereto, certain weekly, monthly, quarterly, semi-annual and annual statements/reports required to be submitted to the Central Bank are hereby grouped into Category A-1, Category A-2 and Category B as follows:2. Subsec. 2161.3 is hereby amended to read as follows:
a. Categories of reports
- Category A-1 reports are the quarterly published statements of condition of thrift banks (SES II Form 4)
- Category A-2 reports are the consolidated monthly statements of condition (SES-II Form 2) and the quarterly statements of condition by banking unit (SES-II Form 3)
- Category B reports are those required to be submitted to the Central Bank which are not included in Categories A-1 and A-2."
"2161.3 Submission of certain required information/documents — All thrift banks shall submit to the appropriate supervising and examining department of the Central Bank the information/documents required in Appendix 8 [*].3. Subsec. 2161.6 is hereby amended by deleting Item b. (2) thereof and Item b. (3) renumbered as b. (2).
Any changes in the required information submitted after the initial submission, shall be reported to the appropriate supervision and examination department within twenty-five (25) banking days from date of change."
4. Subsec. 2161.7 is hereby amended to read as follows:
"2161.7 Reconciliation of head office and branch transactions — All thrift banks shall prepare monthly reconciliation statements covering transactions between the head office and all its branches within fifteen (15) days after the end of each month. The reconciliation statement shall be made available to any duly authorized bank examiner for inspection/examination without need of advance notice.5. The first paragraph of Subsec. 2161.8 and item a thereof are hereby amended to read as follows:
All items which are unresponded or outstanding for more than six (6) months as of date of reconciliation statement shall be reported semestrally in the prescribed report form with explanations/reasons for their being out-standing to the appropriate supervising and examining department within thirty (30) banking days from June 30 and December 31 of each year."
"2161.8 List of Stockholders and their Stockholdings — The following guidelines are adopted to facilitate the preparation and submission of report form SES-II Form 7:6. Subsec. 2161.12 is hereby amended to read as follows:
- Banks shall submit semestrally in duplicate to the appropriate supervising and examining department, a complete list of stockholders and their stockholdings and all other relevant information called for in SES-II Form 7 within twelve (12) banking days after end of semester."
"2161.12 Published Statement of Condition — All thrift banks shall accomplish SES-II Form 4 (Statement of Condition ) and publish the same at the end of each quarter or on such date designated by the appropriate supervising and examining department of the Central Bank.The names and positions/designations of: members of the board of directors, President and Executive Vice-Presidents (Senior Vice-Presidents if there are no Executive Vice Presidents) shall be published as of June every year, starting June 1987, and presented in the right side column of the published statement."
Such statement of condition shall be published in a newspaper of general circulation in the City/Province where the thrift bank has its head office or, in the absence of such newspaper in such City/Province, in the City of Manila or in any other area in the region where the principal office of the thrift bank is located.
A copy of such published statement together with the publisher’s certificate shall be submitted to the appropriate supervising and examining department within twenty (20) banking days from receipt of call.
7. Subsec. 2161.13 on the submission of reports of stockholders/board of directors’ resolutions is hereby deleted.
8. Subsec. 2331.3 is hereby amended to read as follows:
"2337.3 Submission of financing plans — Financing plans and amendments thereto shall be submitted to the Central Bank for prior approval within thirty (30) calendar days from approval thereof by the bank’s Board of Directors.9. Appendices 8 and 9 on the submission of certain information/documents shall be consolidated and simplified as Appendix 8.
Modifications of existing programs to conform with these rules must be submitted within the period above stated."

This Circular shall take effect immediately.
