AMENDMENT TO NFA CIRCULAR 88 NO. 026 ON THE REQUIREMENTS FOR THE IMPORTATION OF FEEDGRAINS AND THEIR SUBSTITUTES
Pursuant to Presidential Decree No. 4, as amended, NFA Council Resolution No. 13-87 dated September 8, 1987, and Administrative Order No. 272 dated 13 March 1992 prohibiting the importation of feedgrains and their substitutes except soybeans without prior permit and clearance from the NFA, all private banks, importers and all concerned are hereby enjoined to secure an import permit and clearance from the NFA prior to the importation and opening of the Letter of Credit of the following commodities, to wit:
Applications for Import Permit with incomplete requirements shall not be accepted/processed.
Prior to the issuance of the approved import permit, the importer shall pay the appropriate import permit processing fee as approved by NFA Council per Resolution No. 147-91 dated 11 July 1991. This fee will cover all expenses incurred by NFA in the processing of the import permit.
Generally, import permits shall be valid for a maximum period of 120 calendar days covering the period from date of issuance of import permit up to the expected latest date of vessel arrival. For corn and its major substitutes such as feedwheat, barley, feedoats and others, the NFA reserves the right to determine the validity period of the import permit such that its effectivity will not have adverse effects or coincide with the harvest season. No extension of permit shall be allowed.
Furthermore, the importation/exportation of rice can only be legally undertaken exclusively by the government through NFA per Executive Order No. 1028.
Non-compliance with this Letter Circular shall subject the offender to prosecution and the penalties provided for under Presidential Decree No. 4, as amended, and other applicable laws, rules and regulations without prejudice to the imposition of administrative sanctions.
Any provisions of letter circular, orders and regulations inconsistent with the provisions of this Letter Circular is hereby repealed and/or modified accordingly.
This Letter Circular shall take effect immediately.

NFA shall not, however, be precluded from requesting importers of additional requirements.
