BAN FOR APPREHENDED "COLORUM" VEHICLES AS WELL AS THEIR OWNERS



It has been reported that numerous apprehensions have been made by the law enforcement agencies against "colorum" operations.  Despite such apprehensions, violators still continuously engage in such operation by simply paying the required penalty.  In curbing these illegal operations, the government launched an inter-agency campaign against colorum operations to contribute to the inadequacy of present government resources, which inadequacy is grossly exploited by violators.  It is, thus, the bounden duty of this Board to help eradicate, or at least reduce to the lowest level, colorum operations.

In view thereof and in coordination with the different law enforcement agencies, all private motor vehicles apprehended thrice for operating as for-hire without the required Certificate of Public Convenience (CPC) shall forever be banned to be used as public utility vehicles if they are applied for and the owner/s of such vehicles are also banned to obtain any franchise from this Board.  If franchise has been granted to such owner/s for other units, all franchises previously issued shall be cancelled and revoked after due notice and hearing.

The Management Information Division of this Board and the Records Section of its Regional Offices are directed to request an inventory of motor vehicles apprehended for colorum operation from the law enforcement agencies on a monthly basis.

All other issuances or parts hereof which are inconsistent herewith, are therefore modified or superseded accordingly.

This Circular shall take effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09, October 1992.
