APPLICATION FOR AUTHORITY TO ALLOW MARINE SURVEYORS, SUPERCARGOES, SHIPOWNER REPRESENTATIVES AND OTHER PERSONS ONBOARD SHIPS IN THE DOMESTIC TRADE



Pursuant to the mandate of the MARINA under P.D. No. 474, E.O. 125, 125-A, R.A. 9295 and its IRR, and to ensure the safety of ship, its crew and all other persons onboard such as marine surveyors, supercargoes, and shipowner representatives, the following guidelines are hereby promulgated:

Coverage

These guidelines shall apply to all shipowners/operators/charterers that shall carry marine surveyors, supercargoes, shipowner’s representatives and other persons other than passengers and crew onboard ships in the domestic trade during a specific voyage performing functions that do not relate to the navigation/operation of ships.

Application for Letter-Authority

All shipowners/operators/charterers/cargo owners shall be required to secure authority from the MARINA before they can carry marine surveyors, supercargoes, ship-owner representatives and other persons onboard ships in the domestic trade indicating the specific voyage and its duration.

Documentary Requirements

  1. Letter of intent;

  2. Employment Contract between the shipowner/operator or shipper/cargo owner and the personnel who shall board the ship indicating therein the specific duties and responsibilities of the parties;

  3. Certification from the shipping company attesting that life-saving equipments and facilities, and accommodation onboard ship are sufficient to cover the subject personnel;

  4. Justification why a particular person who is neither a passenger nor a member of the crew will be authorized/allowed to board the ship.

Duration of Authority

The letter-authority to be issued by the MARINA shall be valid for a specific voyage and duration as indicated in the application.

Implementing MARINA Circular

The MARINA shall subsequently issue the pertinent MARINA Circular to implement the foregoing requirement/application.
