(NAR) VOL. 13 NOS. 1-2 / JANUARY-MARCH 2002

[ BI OFFICE MEMORANDUM ORDER NO. ADD-02-005, JUNE 14, 2002, June 14, 2002 ]

MOTION FOR RECONSIDERATION FOR CANCELLED LEGALIZED STATUS UNDER REPUBLIC ACT NO. 7919

Section 4.3.1 of Republic Act (R.A.) No. 7919 otherwise known as the Alien Social Integration Act of 1995” allows for payment of the alien social integration fee on installment — One Hundred Thousand Pesos (P100,000.00) upon filing of the registration forms with the bank plus Fifty Thousand Pesos (P500,000.00) per year over a three-year period from the payment of first installment.

The Legalization Program under R.A. No. 7919 ended on June 10, 1997. The three-year period mentioned in the above-cited section of the law should have ended not later than 31 December 2002.

The Bureau of Immigration, in order to generate more revenues for the government extended the period up to 31 December 2001. Despite notice, a number of ASIO beneficiaries failed to complete their payments.

In 2002, the Bureau started to cancel the legalized status of those who were not able to fully pay their alien social integration fees.

As a matter of policy and in order to contribute more to the coffers of the government, all motions for reconsideration (MRs) of the cancelled legalized status under R.A. 7919 shall be given due course by the Alien Social Integration Office (ASIO) only after payment of the MR fee of P510.00, administrative fine of P20,000.00 (principal), P10,000.00 (spouse) and P5,000.00 (each dependent/children) and Express service fee of P1,000.00 each.

This OMO shall take effect immediately.

Adopted: 14 June 2002

Commissioner
