[ MMDA REGULATION NO. 20-006, S. 2000, September 21, 2000 ]

REQUIRING ALL VEHICLES CARRYING EXPLOSIVES AND HIGHLY FLAMMABLE MATERIALS TO UTILIZE SERVICE ROADS INSTEAD OF USING TUNNELS/DEPRESSED STRUCTURES IN METRO MANILA



WHEREAS, vehicles carrying explosives and highly flammable materials pose grave danger to people's lives who are in transit;

WHEREAS, the danger posed by vehicles loaded with explosives and highly flammable materials becomes greater when said vehicles are within tunnels/depressed structures that have enclosures;

WHEREAS, it is necessary to adopt measures that would keep the streets of Metro Manila safe for all motorists;

WHEREAS, many of the tunnels/depressed structures constructed in Metro Manila are provided at-grade or ground level service roads mainly utilized by public utility vehicles and those taking a turn at the intersection.

NOW THEREFORE, pursuant to Section 6 of RA 7924, this Regulation is hereby promulgated and adopted by the Metro Manila Council, that:

SECTION 1 .       For purposes of this Regulation, Explosives and Highly Flammable Materials shall mean any substance that may tend to explode such as LPG tank, gasoline tank, acetylene, oxygen tank, helium gas, gun powder, dynamite, fire crackers and the like.

SECTION 2 .       Coverage. — This Resolution shall apply to all vehicles carrying explosives and highly flammable materials regardless of the gross capacity weight except fuel tanks and similar combustible materials utilized by vehicles to generate power to make the vehicle operational. Where there are no service roads, affected vehicles shall not be allowed access to the tunnel/underpass/depressed structure but shall be diverted to other routes.

SECTION 3.        Vehicles carrying gunpowder dynamite, firecrackers and the like must secure a permit from the Philippine National Police (PNP) or must have a PNP escort while traversing along Metro Manila's service roads.

SECTION 4 .       Penalty. — The driver and owner/operator of vehicle carrying explosives and highly flammable materials shall be jointly and severally liable to the payment of fine in the amount P1,000.00.

SECTION 5.       The MMDA Chairman shall issue the necessary guidelines and implementing rules of this Regulation.

SECTION 6 .       Effectivity. This Regulation shall take effect fifteen (15) days after publication in two (2) newspapers of general circulation.
