[ PRC BOARD OF GEODETIC ENGINEERING RESOLUTION NO. 10, S. 2000, October 30, 2000 ]

ADOPTION OF THE CODE OF ETHICS FOR GEODETIC ENGINEERS EMBODIED IN ARTICLE VII OF THE REVISED RULES AND REGULATIONS OF THE BOARD OF GEODETIC ENGINEERING IMPLEMENTING REPUBLIC ACT NO. 4374, AS AMENDED



WHEREAS, the Board of Geodetic Engineering is empowered to prescribe and/or adopt a Code of Ethics and Professional Standards for the Practice of Geodetic Engineering (Sec. 8 (I), Art. II, R.A. 8560, the “Philippine Geodetic Engineering Act of 1998”).

WHEREAS, the Board of Geodetic Engineering has not, up to present, completed the draft of the Code of Ethical and Professional Standards for the Practice of Geodetic Engineering for adoption as provided under the new Geodetic Engineering Act.

WHEREAS, queries have been posed by parties from the government and private sectors on whether the Code of Ethics promulgated and adopted by the Board under R.A. 4373, the Old Geodetic Engineering Law, is still valid and effective.

WHEREAS, the Board, in its meeting held on September 21, 2000, agreed that pending the completion of a new Code of Ethical and Professional Standards for the Practice of Geodetic Engineering to adopt the Code of Ethics adopted under R.A. No. 4374, copy of which is appended hereto as Annex “A” and made a part of this Resolution which is embodied in Article VI of the Revised Rules and Regulations of the Board of Geodetic Engineering adopted on May 13, 1974 and published in the Official Gazette on October 7, 1974 which shall be valid and effective until superseded by a new Code of Ethical and Professional Standards for the Practice of the Geodetic Engineering under R.A. 8560, the new Geodetic Engineering Act.

This Resolution shall take effect after fifteen (15) days from its publication in the Official Gazette or in a newspaper of general circulation in the Philippines, whichever comes earlier.

CODE OF ETHICS
RA No. 4374

SECTION 1.       Honesty, trustworthiness, efficiency, fair dealings, and the Golden Rules shall be the guiding principles which every geodetic engineer and junior geodetic engineer shall follow in the practice of his profession.

SECTION 2.       Every geodetic engineer and junior geodetic engineer shall assist in improving and elevating the standard of the profession by exchanging relevant information and experience with his fellow geodetic engineers and junior geodetic engineers through technical bulletins or professional associations of which they are members.

SECTION 3.       The following acts shall be considered unprofessional and inconsistent with the honorable and dignified standing of geodetic engineer or junior geodetic engineer:

(a)            To act for his client or employer in professional matters other than as faithful agent or trustee, or to accept any renumeration other than his stated charges for services rendered for his client or employer.

(b)            To attempt to injure falsely or maliciously, directly or indirectly the professional reputation, prospects or business of another geodetic engineer or junior geodetic engineer.

(c)            To attempt to supplant another geodetic engineer or junior geodetic engineer after definite steps have already been taken towards the latter’s employment.

(d)            To compete with another geodetic engineers or junior geodetic engineers for employment on the basis of professional charges, by reducing his usual rate and in this manner, attempting to underbid him after knowing the rate offered by another geodetic engineer or junior geodetic engineer.

(e)            To advertise in self-laudatory language, or in any other manner derogatory to the dignity of the profession.

(f) To use the advantages of being a salaried employee to compete unfairly with the geodetic engineers or junior geodetic engineers in private practice.

(g)            To take advantage for a free of his authority to practice as geodetic engineers or junior geodetic engineer, as the case may be, in the execution of any geodetic engineering work not being done under his personal supervision.

(h)            To take undue advantage of the ignorance, credibility, or confidence of his client or employees and other persons with whom he deals.

(i) To hire the technical employee or employees of a fellow geodetic engineer or junior geodetic engineer without the prior knowledge and/or consent of the latter.

(j)  To utilize the services of geodetic engineer’s aide or another geodetic engineer without being registered with the board as such.

(k)            Joining a firm, partnership, association, or corporation registered prior to the approval of R.A. 4374, one of whose purposes is to engage in geodetic engineering work without actually or actively practicing geodetic engineering in or in behalf of said firm, partnership, association, or corporation, when the same is in actual prosecution of said purpose.

(l)  To act in any manner or engage in any practice which will tend to discredit the honor and dignity of the geodetic engineering profession.

Section 4. Violations of any provisions of this Code shall be deemed sufficient ground for filing a case against the geodetic engineer or junior geodetic engineer concerned and for the suspension or revocation of his certificate of registration as geodetic engineer or junior geodetic engineer.
