WHEREAS, the National Economic Development Authority (NEDA) and the Department of Public Works and Highways (DPWH) suggested amendments to Board Resolution No. 23, Series of 2000, particularly Sections 2 and 4 with the end in view of facilitating the registration and/or issuance of Temporary Special Permits to foreign Civil Engineers allowed by law to practice their profession in the Philippines.

WHEREAS, the Board finds the suggestions of the NEDA and the DPWH well-taken and adopts the same.

WHEREFORE, the Board resolved as it hereby resolves to amend Sections 2 and 4 of Board Resolution No. 23, Series of 2000, as follows:

SECTION 1. Section 2(a) (4) of Board Resolution No. 23, Series of 2000, is hereby amended to read as follows:

"4. Authentic or authenticated copies of the terms and conditions of the Government’s employment offer to the applicant indicating the qualification needed for the position, description of duties, functions and responsibilities, length of employment and other similar or analogous data/information."

SECTION 2.       Section 2(a) (5) of the same Board Resolution is hereby repealed.

SECTION 3.       Section 2(b) (1) of the same Board Resolution is hereby amended to read as follows:

"1.     Whether the Government Agency or Instrumentality availing of the services of the foreign civil engineer has certified that the applicant has been brought in by the Government.”

SECTION 4.       Section 2(b) (2) and (3) of the same Board Resolution are hereby repealed.

SECTION 5.       Section 2(c) is hereby amended to read as follows:

"(c) If the requirement in (b) above is satisfied, the Board shall recommend to the Commission the approval of the issuance of a Temporary Special Permit, stating the scope and limitations of such Permit, including the term/period thereof.  Temporary Special Permit shall be issued to the foreign professional within ten (10) working days from date the application was filed: provided, however, that if the application has not been acted upon within the ten (10) day period, the same shall be considered approved."

SECTION 6.       Section 4(b) (1) of the same Board Resolution is hereby repealed.

SECTION 7.       Section 4(b) (2) of the same Board Resolution is hereby amended to read as follows:

"1.     Whether the Government Agency or Instrumentality in contract with the foreign party employing the foreign civil engineer has certified that the applicant has been brought in by a foreign party that has invested in the Philippines and that such foreign party is allowed by law to bring in foreign civil engineers to work in enterprises where such foreign party has invested."

SECTION 8.       Section 4(c) of the same Board resolution is hereby amended to read as follows:

"(c) If the requirement in (b) above is satisfied, the Board shall recommend to the Commission the issuance of a Temporary Special Permit, including its term or period. Temporary Special Permit shall be issued to the foreign professional within ten (10) working days from date the application was filed: provided, however, that if the application has not been acted upon within the ten (10) day period, the same shall be considered approved."

SECTION 9.       This Resolution shall take effect after fifteen (15) days following its publication in the Official Gazette or in a newspaper of general circulation in the Philippines, whichever is earlier.
