[ NTC MEMORANDUM CIRCULAR NO. 7-9-97, September 05, 1997 ]

FURTHER AMENDMENTS TO THE TELECOMMUNICATIONS AND BROADCASTING AUTHORIZATION PROCESSES



In order to promote efficiency and thus be able to meet the demands of the service brought about by the on-going implementation of the National Telecommunications Development Program, the provisions of parts "E" and "F" of the NTC Practices and Procedures Manual of May 1, 1992, are hereby further amended, as follows:

I

Telecommunications Authorization Process
STEP - ACTIVITY

Step 1 - (NO AMENDMENT)

Step 2 - NOTICE OF HEARING (NOH), INSTRUCTIONS TO APPLICANT

SECRETARIAT prepares the NOH, leaving the date for the initial hearing blank for LD to fill up.

Application routed to BSD which prepares INSTRUCTIONS to the applicant including the information to be provided to the Commission, and checks the list of affected parties to be notified

- Case file sent for review and entry of the date for the initial hearing in the NOH, then forward the same to the SECRETARIAT for mailing to the applicant, returning the case file to LD for conveyance to the hearing Officer-in-charge:

a. the date of initial hearing must be within 20 to 25  days upon return of the file to LD in case all the affected parties reside in Luzon: and

b. Within 30 to 35 days upon return of the case file to LD in case any of the affected parties resides in the Visayas or Mindanao.

- Upon receipt of the NOH, the applicant shall cause publication of the same in a newspaper of general circulation and serves copies thereof with all supporting documents (including annexes) to the affected parties as indicated in the NOH, 15 days prior to the date of the initial hearing.

BROADCASTING AUTHORIZATION PROCESS

STEP -  ACTIVITY

Step 1 - (NO AMENDMENT)

Step 2 - NOTICE OF HEARING (NOH), INSTRUCTIONS TO APPLICANT


SECRETARIAT prepares the NOH, leaving the date for the initial hearing blank for LD to fill up.

- Application routed to BSD which prepares INSTRUCTIONS to the applicant including the information to be provided to the Commission, checks the list of affected parties to be notified.

- Case file sent to LD for review and entry of the date for the initial hearing in the NOH, then forward the same to the SECRETARIAT for mailing of the case file to LD for conveyance to the hearing Officer-in-Charge.

The following shall be observed by the hearing Officer-in-Charge:

a. The date of initial hearing must be within 20 to 25 days upon return of the case all affected parties reside in Luzon; and

b. Within 30 to 35 days upon return of the case file to LD in case any of the affected parties resides in the Visayas or Mindanao.

-  Upon receipts of the NOH, the APPLICANT shall cause publication of the same in a newspaper of general circulation, and serves copies thereof with all supporting documents (including annexes) to the affected parties as indicated in the NOH, at least 15 days prior to the date of the initial hearing.

Steps 3-8 - (NO AMENDMENT)
This Circular shall take effect upon its approval by the Commissioner.
