AUTHORITY OF THE BUREAU OF FOOD AND DRUGS AND DOH-INTEGRATED REGIONAL FIELD OFFICES TO LEVY, ASSESS, COLLECT, AND RETAIN FEES TO COVER THE CERTIFICATION OF SUPERVISION ISSUED IN THE SALES PROMOTION ACTIVITIES INVOLVING RAFFLES, SEEDINGS, AND CONTESTS, PURSUANT TO THE PROVISIONS OF CONSUMER ACT OF THE PHILIPPINES (R.A. 7394)



Pursuant to Article 17(d) of Consumer Act of the Philippines (R.A. 7394) to wit:
Art. 17. Powers, Functions and duties — In addition to their power, functions and duties under existing laws, the concerned department shall have the following powers, functions and duties:

(a) to administer and supervise the implementation of this Article and its implementing rules and regulations;

(b) . . .

(d) to levy, assess, collect and retain fees as are necessary to cover the cost of inspection, certification, analysis and tests of samples of consumer products and materials submitted in compliance with the provisions of this Article;

The Bureau of Food and Drugs and DOH-Integrated Regional Field Offices are hereby authorized to levy, assess, collect and retain fees to cover the cost of certifying supervision in the sales promotion activities of private companies either advertising or sales promotion agencies or sponsoring companies, involving raffles, seeding, contests, etc. involving food, drugs, cosmetics, devices, and hazardous substances, upon the approval of the application for permit to conduct sales promotion activities.

The following shall be the certification fee for sales promotion activity that requires the supervision of a BFAD representative:

a) Weekdays (Monday - Friday) - P350.00 per activity/supervision required

b) Saturdays, Sundays, Holidays and after office hours - P550.00 per activity/supervision required

The corresponding official receipt shall be issued for fees collected and the amount collected shall be deposited in a government bank as a Trust Fund Account for the cost of implementation of Article 116 and its implementing rules and regulation of RA 7394 of the collecting agency of the Department of Health.

The Trust Fund Account shall be the source of fund to pay for the per diem, transportation and meal allowance of DOH-BFAD and DIFRO representatives directed or assigned to attend to the above-mentioned activities involving the subject products and other certification expenses.

The collection, deposit of fees and disbursement of the said fund shall be subject to the usual accounting and auditing rules and regulations.
