PAYMENT OF EXAMINATION FEES UPON FILING OF APPLICATIONS IN LICENSURE EXAMINATIONS AND FOR REGISTRATION WITHOUT EXAMINATION



WHEREAS, Section 7(n) of Republic Act No. 8981 empowers the Commission to adopt and promulgate such rules and regulations as may be necessary to effectively implement policies with respect to the regulation and practice of professions.

WHEREAS, there are applicants for registration without examination (conversion, upgrading, qualified under the grandfather clause) and for licensure examinations, wherein their experience, training, or refresher course are to be evaluated and approved by the concerned Professional Regulatory Board.

WHEREAS, it has been the practice that the applicants were not yet required to pay the examination fees upon the filing of their applications and that the examination fees shall be paid only when the applications are approved by the concerned Professional Regulatory Board.

WHEREAS, from the time of filing of applications, the Commission has in fact, already incurred operational expenses such as manpower services, electricity, supplies and forms, notwithstanding whether the applications will be approved or not.  Moreover, the applicants are duly informed of the requirements prior to the submission of their application.

WHEREFORE, the Commission RESOLVES, as it is hereby RESOLVED, that examination fees shall be paid upon the filing of applications in licensure examinations and for registration without examination.

FURTHER RESOLVED, that the examination fees of applicants whose applications are disapproved by the Professional Regulatory Board shall be forfeited in favor of the Commission.

This Resolution shall take effect fifteen (15) days after completion of publication in the Official Gazette or in a newspaper of nationwide circulation in the Philippines, whichever is earlier.

Let copies of this Resolution be furnished the Department of Education, Commission on Higher Education, schools, colleges or universities, public and private, offering courses for licensure examinations for their information and guidance.
